rights easement on a certain parcel of property owned by N&J Management Company
pursuant to the provisions of Chapter 17 (Community Preservation Fund) and Chapter 70
(Agricultural Lands) of the Code of the Town of Southold. Said property is identified as part of
SCTM #1000-113-13-1.2. The address is 4735 Westphalia Road, Mattituck, New York, and is
located on the southerly side of Westphalia Road, approximately 830 feet east of the intersection
of Cox Neck Road and Westphalia Road in Mattituck in the R-80 zoning district. The proposed
acquisition is for a development rights easement on a part of the property consisting of
approximately 16.5± acres (subject to survey) of the 17.5± acre parcel. The exact area of the
development rights easement is subject to a survey acceptable to the Land Preservation
Committee and the property owner. The purchase price for the easement is $68,000 (sixty-eight
thousand dollars) per buildable acre plus acquisition costs; now, therefore, be it

Said properties are

Parcel A is located at the northwesterly side of Oregon Road where Elijah’s Lane intersects with

Parcel B is accessed by means of a right of way over Parcel A located approximately 3,500 feet
easterly from the intersection of Lloyds Lane and Sound View Avenue in Mattituck in the A-C
zoning district. The proposed acquisition is for a development rights easement on a part of the
property identified as SCTM #1000-100-2-6.1 consisting of approximately 24± acres of the 27±
acre parcel, and a development rights easement on the entire adjacent parcel identified as SCTM
#1000-94-4-2 consisting of 5± acres.
The exact area of the purchase is subject to a Town-provided survey acceptable to the Land
Preservation Committee and the property owner. The purchase price is $78,000 (seventy-eight
thousand dollars) per buildable acre for the 24± acre easement and $448,000 (four hundred forty-
eight thousand dollars) for the easement on the entire 5± acre adjacent parcel plus acquisition
costs. Both easements will be acquired using Community Preservation Funds. The 24± acre
easement purchase may be eligible for partial funding from an awarded NYS Agriculture and
Markets grant.
The properties are listed on the Town’s Community Preservation Project Plan as properties that
should be preserved due to their agricultural values; and

is hereby given that a more detailed description of the above mentioned
parcel of land is on file in Land Preservation Department, Southold Town Hall Annex, 54375

BE IT ENACTED
by the Town Board of the Town of Southold as follows:
I. Purpose –
In order to provide for the health, safety and welfare of the citizens of the Town,
it is necessary for the Town Board to make amendments to the Town’s vehicle and traffic
regulations, including regulations regarding parking in fire lanes, handicapped spaces, and other
areas, as well as updating and consolidating the fines for various infractions.
II.
Chapter 189 of the Code of the Town of Southold is hereby amended as follows:
§189-8. Penalties for offenses.[Amended 7-31-1973 by L.L. No. 1-1973]
Any person committing an offense against any provision of this article shall, upon conviction
thereof, be guilty of a violation punishable by a fine as set forth below not exceeding $250 or by
imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment. The
continuation of an offense against the provisions of this article shall constitute, for each day the
offense is continued, a separate and distinct offense hereunder.

Chapter 193 of the Code of the Town of Southold is hereby amended as follows:
§193-3. Regulations concerning motor vehicles.
A. No person in a recreational area shall:
(6) Park a vehicle in other than an established or designated parking area, and
such use shall be in accordance with the posted instructions thereat and with the
instructions of any attendant who may be present.
IV.
Chapter 260 of the Code of the Town of Southold is hereby amended, as follows:
§260-8. Parking prohibited at all times.
The parking of vehicles is hereby prohibited at all times in any of the following

locations and at any other location where signage indicates “No Parking”:
§260-12. Public parking lots.

The parking of vehicles in the a public parking lot located in Southold on the south
side of New York Route 25, approximately 170 feet east of Wells Avenue, is hereby
prohibited for a period longer than two hours. for a period of more than two hours is
hereby prohibited at the following locations:

A. The parking of vehicles is hereby prohibited at all times in the following fire
lane locations zones:

A1. At the shopping center located on the north side of New York Route
25, approximately 1,400 feet west of Cox Lane in the Hamlet of
Cutchogue, commonly known as the “Key Food Shopping Center,”
such fire lane to be 30 feet in width from the southerly sidewalk
curbline on the south side (front) of the building and extending for the
entire length of the store building.
B.2. At the shopping center located on the north side of New York Route
25, having ingress and egress on both Route 25 and Factory Avenue in
the Hamlet of Mattituck, commonly known as the “A & P Shopping
Center,” such fire lane to be 24 feet in width, from the southerly and

westerly sidewalk curbline on the south and west (front) side of the
building and extending the entire length of the L-shaped store
building; i.e., 466 feet along the southerly face of the building and

B. The stopping, standing or parking of vehicles within 15 feet in either direction
of a fire hydrant is hereby prohibited.
C. The stopping, standing or parking of vehicles within 15 feet in either direction
of a fire well is hereby prohibited.
D. The stopping, standing or parking of vehicles is prohibited at all times in the
areas designated and marked as fire lanes.
§260-17. Handicapped parking.

C.B. No person shall park a vehicle in whole or part on a sidewalk located adjacent
to a highway.
D.C. No vehicle shall be parked upon any public highway or roadway without first
being registered and inspected pursuant to the Vehicle and Traffic Law of the
State of New York.
E.D. On a one-way roadway vehicles shall be parked facing in the direction of
authorized traffic movement; on a two-way roadway such motor vehicle shall
be facing in the direction of authorized traffic movement on that portion of the
roadway on which the vehicle rests.
F.E. No person shall park a vehicle so as to obstruct any driveway except with
express permission of the owner.
G. No person shall park a vehicle overtime in a time restricted parking space.
F. In an established or designated parking area, a vehicle is to be wholly within
the markings or signage where established or designated lines and markings
are indicated.
§260-27. Penalties for offenses.
A. Every person convicted of a traffic infraction for a violation of any provision of this
chapter, which is not a violation of any provision of the Vehicle and Traffic Law of
the State of New York, and said traffic infraction is not covered by Subsection B
below, shall, for a first conviction thereof, be punished by a fine of not more than $50
not to exceed $110 or by imprisonment for not more than 15 days, or by both such
fine and imprisonment.; for a second such conviction within 18 months thereafter,
such person shall be punished by a fine of not more than $100 or by imprisonment for
not more than 45 days, or by both such fine and imprisonment; upon a third or
subsequent conviction within 18 months after the first conviction, such person shall
be punished by a fine of not more than such person shall be punished by a fine of not
more than $250 or by imprisonment for not more than 90 days, or by both such fine
and imprisonment.
B. All persons cited on a Town parking summons for violation of this chapter,
permit parking or parking related violations shall be subject to a fine as set
forth below and shall answer on or before 30 days after the issuance of the
summons. Persons failing to answer before the expiration of 30 days after
issuance of the summons shall be subject to the penalties set forth in the
penalty schedule below, in addition to the prescribed fines:

LOCAL LAW NO. 2007
“A Local Law in relation to Amendments to Exemption for Volunteer
A Local Law entitled,
Fire Fighters and Ambulance Workers.
BE IT ENACTED
by the Town Board of the Town of Southold as follows:
I. Purpose
– The Town Board of the Town of Southold seeks to provide to unremarried
spouses of volunteer fire fighters or ambulance workers killed in the line of duty the maximum
exemption from Town-imposed taxes available under New York State Law.
II.
Chapter 245 of the Code of the Town of Southold is hereby amended as follows:
§245-13. Unremarried spouses of volunteer fire fighters or ambulance workers
killed in line of duty. [Added 6-20-2006 by L.L. No. 9-2006]
Any exemption granted under §245-11 to an enrolled member of an incorporated
volunteer fire company, fire department, or incorporated volunteer ambulance
service shall be extended to such deceased enrolled member’s unremarried spouse
if such member is killed in the line of duty; provided, however, that:
A. Such unremarried spouse is certified by the authority having jurisdiction
for the incorporated volunteer fire company, fire department or incorporated
volunteer ambulance service as an unremarried spouse of an a deceased enrolled
member of such incorporated volunteer fire company, fire department or
incorporated voluntary ambulance service who was killed in the line of duty; and
B. Such deceased volunteer died in the line of duty and had been an enrolled
member for at least five years; and
C. Such deceased volunteer had been receiving the exemption prior to his or
her death; or

D. Such deceased member had been an enrolled member for at least twenty
years; and
E. Such deceased volunteer and unremarried spouse had been receiving the
exemption prior to his or her death.
III. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV. APPLICABILITY AND EFFECTIVE DATE
This Local Law shall apply to assessment rolls prepared on the basis of taxable status
dates occurring on or after January 1, 2007. This Local Law shall take effect Immediately upon
filing with the Secretary of State as provided by law.

“A Local Law in relation to Exemption for Veterans and Gold Star
A Local Law entitled,
Parents.
BE IT ENACTED
by the Town Board of the Town of Southold as follows:
I. Purpose
– The Town Board of the Town of Southold seeks to provide to certain
war veterans and gold star parents the maximum exemption for Town-imposed taxes available
under New York State Law.
II.
A new Article VI of Chapter 245 of the Code of the Town of Southold is hereby
adopted as follows:
§245-15. Definitions.
As used in this Article, the following terms shall have their meanings indicated:
GOLD STAR PARENT – A parent of a child who died in the line of duty while
serving in the United States Armed Forces during a period of war.
PERIOD OF WAR – The Spanish-American War; the Mexican border period:
World War I: World War II: the hostilities known as the “Korean War”, which
commenced June 27, 1950, and terminated on January 31, 1955; the hostilities
known as the “Vietnam War”, which commenced December 22, 1961, and
terminated on May 7, 1975; and the hostilities known as the “Persian Gulf
conflict”, which commenced August 2, 1990.
VETERAN – A person:
A. Who served in the active military, naval, or air service during a period of war or
who was a recipient of the armed forces expeditionary medal, naval expeditionary medal,
Marine Corps expeditionary medal or global war on terrorism expeditionary medal, and
who was discharged or released therefrom under honorable conditions; or
B. Who was employed by the War Shippings Administration or Office of
Defense Transportation or their agents as a merchant seaman documented by the
United States Coast Guard or Department of Commerce or as a civil servant
employed by the United States Army Transportation Service (later redesignated as

the United States Army Transportation Corps, Water Division) or the Naval
Transportation Service; and who served satisfactorily as a crew member during
the period of armed conflict, December 7, 1941, to August 15, 1945, aboard
merchant vessels in oceangoing (i.e., foreign), intercoastal or coastwise service, as
such terms are defined under federal law (46 U.S.C.A. §§10301 and 10501), and
further to include near-foreign voyages between the United States, Canada,
Mexico or the West Indies via ocean routes or public vessels in oceangoing
service or foreign waters and who has received a certificate of release or discharge from
active duty and a discharge certificate or an honorable service certificate/report of
casualty from the Department of Defense;
C. Who served as a United States civilian employed by the American Field
Service and served overseas under United States Armies and United States Army
Groups in World War II during the period of armed conflict December 7, 1941,
through May 8, 1945, and who was discharged or released therefrom under
honorable conditions; or
D. Who served as a United States civilian flight crew and aviation ground
support employee of Pan American World Airways or one of its subsidiaries or its
affiliates and served overseas as a result of Pan American’s contract with Air
Transport Command or Naval Air Transport Service during the period of armed
conflict, December 14, 1941, through August 14, 1945, and who was discharged
or released therefrom under honorable conditions.
§245-16. Exemption granted to veterans and Gold Star parents.
A. The maximum exemption allowable to qualifying residential real property exempt
from taxation, under §458-a of the New York Real Property Tax Law to the extent of
15% of the assessed value, shall be increased from $27,000 to $54,000.
B. In addition to the exemption provided by Subsection A of this Section, the
maximum exemption allowable to veterans who served in a combat theater or
combat zone of operations, as documented by the award of the United States
Campaign Ribbon or Service Medal, or the armed forces expeditionary medal,
naval expeditionary medal, Marine Corps expeditionary medal, or global war on
terrorism expeditionary medal shall be increased from $27,000 to $36,000.
C. The maximum exemption allowable, as an additional exemption available
to a veteran who has received a compensation rating from a New York veterans
organization or the United States Department of Defense because of a service-
connected disability, calculated as the product of the assessed value multiplied by
50% of the veteran’s disability rating under §458-a of the New York Real
Property Tax Law, is hereby increased from $90,000 to $180,000.

D. The County of Suffolk hereby elects to include a Gold Star parent within the
definition of “qualified owner” and to include property owned by a Gold Star parent
within the definition of “qualifying residential real property”, as provided in §458-a(1)(c)
and (d) of the New York Real Property Tax Law, on the condition that such property
shall be the primary residence of the Gold Star parent. The exemption granted by
Subsections A and B of this section are hereby extended to the primary residences of
Gold Star parents located within the Town of Southold. The real property tax exemption
provided to Gold Star parents under §458-a of the New York Real Property Tax Law is
hereby extended to such Gold Star parents to the maximum extent permissible under state
law.
E. Where a veteran already receiving an exemption pursuant to Section 458 or 458-a
of the Real Property Tax Law sells the property receiving the exemption and purchases
property within the same town or village, the assessor shall transfer and prorate, for the
remainder of the fiscal year, the exemption which the veteran received. The prorated
exemption shall be based upon the date the veteran obtains title to the new property and
shall be calculated by multiplying the tax rate or rates for each municipal corporation
which levied taxes, or for which taxes were levied, on the appropriate tax roll used for the
fiscal year or years during which the transfer occurred times the previously granted
exempt amount times the fraction of each fiscal year or years remaining subsequent to the
transfer of title. Nothing in this section shall be construed to remove the requirement that
any such veteran transferring an exemption pursuant to this section reapply for the
exemption authorized pursuant to Section 458-a of the Real Property Tax Law on or
before the following taxable status date, in the event such veteran wishes to receive the
exemption in future fiscal years.
III. SEVERABILITY

court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.

the Town Board of the Town of Southold held a public hearing on the question of
the purchase of a development rights easement on a certain parcel of property owned by N&J
Management Company on the 13th day of March, 2007, pursuant to the provisions of Chapter 17
(Community Preservation Fund) and Chapter 70 (Agricultural Lands Preservation) of the Town
Code, at which time all interested parties were given the opportunity to be heard; and
WHEREAS,
said property is identified as part of SCTM #1000-113-13-1.2. The address is 4735
Westphalia Road, Mattituck, New York, and is located on the southerly side of Westphalia Road,
approximately 830 feet east of the intersection of Cox Neck Road and Westphalia Road in
Mattituck in the R-80 zoning district; and
WHEREAS,
the development rights easement comprises approximately 16.5± acres (subject to
survey) of the 17.5± acre parcel. The exact area of the development rights easement is subject to
a survey acceptable to the Land Preservation Committee and the property owner; and
WHEREAS, t
he purchase price for the easement is $68,000 (sixty-eight thousand dollars) per
buildable acre plus acquisition costs. The easement will be acquired using Community
Preservation Funds. The easement purchase may be eligible for partial funding from an awarded
NYS Agriculture and Markets grant; and
WHEREAS,
the property is listed on the Town’s Community Preservation Project Plan as
property that should be preserved due to its agricultural value; and
WHEREAS,
the purchase of the development rights on this property is in conformance with the
provisions of Chapter 17 (Community Preservation Fund) and Chapter 70 (Agricultural Lands
Preservation) of the Town Code, and
WHEREAS,
the proposed action has been reviewed pursuant to Chapter 268 (Waterfront
Consistency Review) of the Town Code and Local Waterfront Revitalization Program (LWRP)
and the LWRP Coordinator has recommended that this action is consistent with the LWRP; and
WHEREAS,
the Land Preservation Committee has reviewed the application for the acquisition,
and recommends that the Town Board acquire the development rights easement; and
WHEREAS,
the Town Board deems it in the best public interest that the Town of Southold
purchase the development rights on this agricultural land; now, therefore, be it
