Hyatt; running thence along said land of Robert L. Hyatt, three courses and distances : (1) North 13 degrees 58 minutes West/1],. 69 feet; (2) North 82 degrees 02 minutes East 70 feet; (3) South 13 degrees 58 minutes East 148,03 mizzkRs feet to the westerly side of said other 20 foot right of way ; thence along the westerly side of said other 20 foot right of way, South 20 degrees 09 minutes West 10 feet to its intersection with the northerly side of the first described 20 foot right of way at the point or place of BEGINNING TOGETHER with a right of way for ingress and egress over a roadway as traveled, running northerly from a point in the northerly side of Sound View Avenue which is distant 571. 79 feet easterly from the easterly side of Horton' s Lane as measured along the northerly side of Sound View Avenue, to the premises herein, as said right of way is delineated on a survey by Otto W. Van Tuyl and Son, dated October 19, 1965 and amended January 14, 1966, and recorded in Liber 5910 cp 506. LESTER M. BEING AND INTENDED TO BE the same premises conveyed to the party of the first part and the party of the second part as tenants by the entirety by deed dated November 1, 1971, recorded November 10, 1971 in the Suffolk County Clerk' s Office in Liber 7044 of Deeds, at page 129, it being the intention of this instrument to convey to the party of the second part all of the right, title and interest of the party of the first part conveyed to the party of the first part by the deed aforesaid. SUBJECT TO a first mortgage made by the party of the first part and the party of the second part to the Southold Savings Bank, dated November 1, 1971, recorded November 10, 1971 in the Suffolk County Clerk' s Office in Liber 6195 of Mortgages at page 96, on which mortgage there is now due the principal balance of $15,970.60, with interest thereon from January 1, 1974, said mortgage being in the face amount of $16,500.00. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
