WILSBERG, residing at (no number) Kraus Road, + ' ra Mattituck, New York, o U m c .A is to party of the first part, and TOWN OF SOUTHOLD, a municipal corporation of the State z z of New York, having an office and place of business at 16 South Street, Greenport, New York, 00 C�? �I^ party of the second part, WrIT4METH,that the party of the first part,in consideration of Ten Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs t or successors and assigns of the party of the second part forever, �� ���Ee�reoxpeLxaL�k>bklax amchiimgxB�eRR�EE]L9ZAdcxit}r�Ilt; An easement or right-of-way 5 feet in width for highway drainage purposes together with the right to lay pipes and other drainage facilites and to maintain, operate, remove and replace said drainage facilities over and through the land hereinafter described, to wit: ALL that certain parcel, piece or plot of land situate, lying and being at Southold, in the Town of Southold, Suffolk County, New York, being a strip of land 5 feet in width described as follows: BEGINNING at a point formed by the intersection of the easterly line of Main Bayview Road with the southerly line of Lot No. 2 as shown on a certain map entitled "Map of West Creek Estates" files in the Suffolk County Clerk's Office on August 19, 1963 as Map No. 3848; from said point of beginning running thence easterly along said southerly line of Lot No. 2, 174 feet, more or less. to an area designated on said map "To be dredged"; thence in a northerly direction a distance of 5 feet, more or less, to a point which is 5 feet distant from said southerly line of Lot leo. 2 when measured at right angles thereto; running thence in a general westerly direction through said Lot No. 2 and at all point 5 feet distant from the southerly line of•said Lot No. 2 measured at right angles thereto a distance of 174 feet to said easterly line of Main Bayview Road; thence along said easterly line of Main Bayview Road in a southerly direction a distance of 5 feet, more or less, to the point or place of beginning. TOGETHER with the right to discharge surface waters for highway drainage purposes into said area designated on the aforesaid map as "To be dredged". TOGETHER with all right, title and interest, if any, of the party o£ the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first pant covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
