THIS INDENTURE,made the 23rd day of July nineteen hundred and seventy three
BETWEEN
Ellis W. Gaskell and Jacqueline Gaskell, his wife, both residing at

Eugene H. Bailey and Florence Bailey, his wife, both
a residing at North Country Road, Wading River, N.Y. 11792
party of the second part,
WMESSETH,that the party of the first part,in consideration of Ten Dollars and other valuable consideration
paid by the party of the second part,does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
.ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
at P-ine--Neek,-in tie Town of Southold, County of SuffDik and
tate of New York, bounded and described as follows:
41NNING at a, point where the northerly line of the right of way intersects the
1 ' #p easterly line of baklawn Avenue, said point being 383.96 feet north of the intersection
•. of the said Oaklawn Avenue with the northerly line of Pine Neck Road; running thence
North 10 degrees 58 minutes 20 seconds East the following two courses and distances:
q1 CJ (1) North 10 degrees 58 minutes 20 seconds East 11.47 feet; (2) North 10 degrees
q 58 minutes 20 seconds East 23.57 feet, to an iron pipe set at an angle in the
easterly side of Oakltswn Avenue; running thence North 13 degrees 01 minutes
40 seconds West 70 feet; thence still along the said side of said Avenue and part
of the way along bridge abutment North 11 degrees 37 minutes West 29 feet; more or
less to- a timber bulkhead; thence along the timber bulkhead as it twists and turns
with the ordinary high water mark of Jockey Creek the following four distances:
(1) Easterly 16 feet, more or less; (2) Southeasterly 37 feet, more or less;
(3) Easterly 45 feet, more or less and (4) Southerly 43 feet, more or less; thence
running along the ordinary high water mark of Jockey Creek, 14 feet, more or less,
to a point where the dividing line between the premises herein and the land now or
formerly of Beatrice Nehrbus intersects the high water mark; running thence along
Ehe- landof said Beatrice Nehrbus South 7 degrees 18 minutes West 56 feet to a
point in the northerly line of the aforementioned right of way; running thence
South 76 degrees 48 minutes 40 seconds West 94.12 feet to the point or place of SNS
BEGINNING.
Excepting so much as may be reserved for Town purposes.
Subject to any state of facts an accurate survey may indicate.
Subject to d former purchase money mortgage on which there is due and owing the
sum of $13,782.97 with interest from JLily 12, 1973.
TOGETHER with all right, title-and interest, if any, of the pafity of the first part in and to any streets and
roads abutting the above described premises to the center lines.thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND,TO i
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.

AND'the party of�th fi4st part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance vi Section 13 of the Lien Law, covenants that the party of E
the first part will receive the consideration`for this conveyance and will hold the right to receive such consid-
eration s a trust
fund to be applied first for the purpose of paying thg cost of the improvement and will apply
the same first to the payment of the cost of the improvepent before using any part of the total of the same for
any other purpose.
The word "party". shall be construed'as if it read "parties" whenever the sense of this indenture so requires.
