the party of the second part, does hereby grant and release unto the party of the second part,the heirs or successors

State of New York, bounded and described as follows: BEGINNING at a concrete monument
set on the southerly line of North Bayview load at the northeasterly corner of land
of Howard A. Toedter, Inc., and the northwesterly corner of land of Frank Stelzer,
which said point is 577.56 feet west of the intersection of the westerly side of
Jacobs Lane and the Southerly side, of North :ayview Road, as measured along the
southerlg side of North Bayview Road and;. running along said land of Frank Stelzer,
South 28 1111 301' west 521.93 feet; running thence along land conveyed or about to
be conveyed by Howard A. Toedter, Inc., to Frank Stelzer, South 280 4.11 301, West
78.27 feet to other land of Howard A. 'Toedter, Inc.; running thence along said other
land of Howard A. Toedter, Inc, two courses as follows: 1) North 570 341 loll 'West
587.21 feet; thence 2) North 27b 431 1011 hast 431.91 feet to a concrete monument
set on said southerly litre of North Bayview Road; running thence along said southerly
line of North Bayview Road South 73° 401 20n East 607.37 feet to the pointlor place
of beginning.
SUBJECT to building and zoning ordinances of the Town of Southold.
SITBJECT to any state of facts an accurate survey may show.
SUr3J's'CT to a first mortgage in the face amount of ::11,000.00, which the party of
the second part agrees to assume and pay pursuant to the terms thereof.
SUBJECT to a second purchase money mortgage in the face amount of w16,000.00.
Together with all right, title and interest, if any, of the party of the first'part in and to any streets and roads abutting
the above described premises to the center lines thereof; Together with the appurtenances and all the estate and
rights of the party of the first part in and to said premises;To Have And To Hold the premises herein granted unto the -
party of the second part,the heirs or successors and assigns of the party of the second part forever.
And the party of the first part covenants that the party of the first part has not done or suffered anything whereby the
said premises have been encumbered in any way whatever,except as aforesaid.
And the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust
fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the pay-
ment
ayment of the cost of the improvement before using any part of the total of the same for any other purpose.
The word "party"shall be construed as if it read "parties"whenever the sense of this indenture so requires.
