Thompson, deceased, late of Suffolk County, New York, 0(0 ' Hortons Lane, Southold, New York aax:m = xxk a xxHAtatRx ea�rof * x9ed, party of the first part, and ERNEST ROSITZKE and RUTH ROSITZKE, his wife, residing at(N0 aJMOM) 46604i�1C A�e�Stony Brook, New York, F party of the second part, WITNESSETH, that the party of the first part, by virtue of the power and authority given in and by said last will and testament, and in consideration of TWENTY—FIVE THOUSAND SIX HUNDRED ($25, 600.00) ------------------------------------------------- dollars, paid by the party of the second part, does hereby grant and Cal release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, - .�j lying and being in the Town of Southold,County of Suffolk and State of New York, at Southold, bounded and described as follows: BEGINNING at a point on the easterly side of Youngs Avenue distant 20, feet southerly of the intersection of the southerly line of land lately owned by William C.Albertson and the easterly line of said Youngs Avenue iX and running easterly from said point and at right angles to Youngs Avenue 1' along other land of the parties of the first a distance of 140 feet. to a wpoint;thence southerly along other land of the parties of the first part and on a line parallel to the easterly side of Youngs Avenue,a distance of 60 feet (to a point; thence Westerly and on a line at right angles:' to Youngs Avenue and parallel with the northerly side hereof a distanoe of 140 feet) to the easterly side of Youngs Avenue; thence northerly along the easterly side of Youngs Avenue at a distance of 60 feet to the point or place of BEGINNING. - Together with the right of way for passage on foot and with vehicles along the northerly side of the premises conveyed hereby which was granted by deed dated December 6th, 1927 from Frank L. Downs, Arthur T. Downs and Lucinda G. Downs to Susie M. Thompson and Rose L. Thompson recorded in the office of the Clerk for the County of Suffolk at Liber 1305 page 204. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances, and also all the estate which the said decedent had at the time of decedent's death in said premises, and also the estate therein, which the party of the first part has or has power to convey or dispose of, whether individ- ually, or by virtue of said will or otherwise; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. s AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall he construed as if it read "parties" whenever the sense of this indenture so requires.
