THIS INDENTURE, made the Z6 daY of March nineteen hundred and seventy-three,
BETWEEN ERNEST E. WILSBERG and HAROLD W. WILSBERG, both residing at
Olejule Lane (no street number), Mattituck, Suffolk County, New York,
party of the first part, and STANLEY POLIWODA and EVELYN POLIWODA, his wife,
both residing at Terry Lane (no street number), Southold,
Suffolk County, New York,
party of the second part,
WITNESSETH,that the party of the first part, in consideration of Tev. Duliars and other valuable consideration
paid by the party of the second part, does hereby grant and releas: iaazo thy: party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land,]4ess1tR1Y�[ ts�t�uidate,
lying and being im4ft at Southold, Town of Southold, Suffolk County, New York,
known and designated as Lot No. 40 on a certain map entitled "Map of
West Creek Estates, Property of Ernest E. and Harold W. Wilsberg,
situate at Southold, Suffolk County, New York", made by Otto W.
Van Tuyl from surveys completed January 28, 1963, and filed in the
Suffolk County Clerk' s Office on August 19, 1963, as Map No. 3848.
TOGETHER with an easement and right of ingress and egress over any
roads described in said filed map to and from Bayview Road, subject,
however, to the right of ingress and egress granted, or that may
hereafter be granted, to other owners of numbered lots on said map
and others to whom the same may be granted over the roads and ex-
Ctensions on said map. Further subject to the right of the sellers,
their heirs and assigns, to dedicate the lands included therein to
the Town of Southold as a public highway, which right of dedication
is hereby reserved .

SUBJECT to any state of facts that an accurate survey may show.
SUBJECT to covenants restrictions, utility easements, reservations
• r and agreements of record, and in particular, a declaration of
L„ L covenants and restrictions dated March 9, 1964, and recorded in the
Office of the Clerk of Suffolk County on March 30, 1964, in Liber
5520, page 315, as amended.
TOGETHER with all right, title and interest, if any, of the party of the firstppaarrtt of, in and to any streets and
roads abutting the above-described premises to the center lines thereof; TOGETHER with the
and all the estate and rights of the party of the first part in and to said remises; TO HAVEAND T°O
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will holy: the right to receive such consid-
eration as a trust fund to be applied first for the purpose ofpaying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the will

any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
