WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration

J follows: Commencing at the Northwesterly corner of lands heretofore
conveyed by Walter E. Hyatt to Pauline Bednoski; thence running in
a general northerly direction along the easterly side of a certain
existing twenty foot roadway leading from North Bay View Road to
Town Harbor Bay North 14 degrees 06 minutes 50 seconds East a dista.nt:e
of 75 feet, more or less, to the southwesterly corner of the lands
heretofore conveyed by the said Walter E. Hyatt to Howard Terry; run-
ning thence in a general easterly direction along .the southerly borriid- ,
ary lines of the lands of said Howard Terry a distance of 146. 66 feet,
more or less, to the easterly 'boundary line of the lands of said
Walter E. Hyatt; running thence along the easterly boundary line of
the lands of said Walter E. Hyatt, North 20 degrees, 11 minutes
20 seconds East, a distance of 75 feet, more or less , to the north-
easterly corner of the' lands of Pauline Bednoski; running thence in
a general westerly direction and along the northerly boundary line of
the lands of Pauline Bednoski, a distance of 145.25 feet, more of less,
to the point or place of beginning. Subject to all easements of record.
Together with a right of way over said existing twenty foot
roadway from North Bayview Road to Peconic Bay. Being and intended to
be the same premises described in Liber 2468 cp 581

the party of the second part forever. 1
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
AND the party of the first part covenants as follows: that said party of the first part is seized of the said 6
premises in fee simple, and has good right to convey the sante; that the party of the second part shall quietly i
enjoy the said premises; that the said premises are free from incumbrances, except as aforesaid; that the
party of the first part will execute or procure any further necessary assurance of the title to said premises; and
that said party of the first part will forever warrant the title to said premises.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires,
