WITNESSETH,that the party of the first part,in consideration of Ten Dollars and other valuable consideration
paid by the party of the second part,does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain is piece or parcel of land, with the buildings and improvements thereon erected, situate,
.lying and being in the Town of Southold, County of Suffolk, State of New York,
known and designated as and by lot 96 on a certain neap entitled, "Map of
w l f r Cedar Beach Park, " filed in the Suffolk County Clerk's office as map #90.
SUBJBCT to (1) any state of facts an accurate survey might show; (2) covenants,
restrictions, 'easements, agreements, reservations, and zoning regulations of
ti record; (3) rights of others to pass and repass over the private road known as
Inlet, Way adjacent to said premises on the north.
' TOGETHER with (1) rights of the party of the first part to pass and repass over
the private road known as Inlet Way adjacent to said premises on the north; and
(2) all of the right, title, and interest, if any, of the party of the first part of,
in, and to land lying under, the waters of Little Peconic Bay in front of and
adjoining said premises.
The said lot herein conveyed being bounded and described as follows: beginning
at a point in the southerly line of certain road known as Inlet Way, which is
point of intersection of division line between lots 96 and 97 on aforementioned
° map with southerly line of said Inlet Way, and running thence along said Inlet
Way south 41°05140" east, 151. 05 feet; thence south 16°24100" west, 105-feet
to ordinary high water mark of Little Peconic.Bay; running thence along a tie
line north 70049140" west, 127,,53 feet to aforementioned division line between
Iots 96 and 97, and running thence along said line, north 16°24100" east, 180. 00
feet to the point or place of beginning.
K BEING and intended to be the same premises conveyed to the party of the first

roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
` and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby.the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
m the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
