THIS INDENTURE,made the y day of March , nineteen hundred and seventy-four

ALBERT Me GARBADE, JR, as surviving tenant by the
entirety, residing at Indian Neck Lane (no number) ,
Peconic, New York
party of the first part, and
try ARTHUR Ge GOSSNER, residing at 184-56 Hovenden Road,
Jamaica Estates , Queens County , New York
party of the second part,
WITNESSETH,that the party of the first part, in consideration of Ten Dollars and other valuable consideration
\� paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
*t ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being bubo at Peconic, Town of Southold, County of Suffolk and
Jf State of New York, bounded and described as follows :

BEGINNING at a point on the westerly side of Indian Neck Lane
distant South 24 degrees East 841.32 feet from the corner formed
v c by the intersection of the westerly side of Indian Neck Lane with
the southerly side of Main Road (N.Y.S. Rte 25) ; running thence along ,
the westerly side of Indian Neck Lane South 24 degrees East 100 feet
to a point; running thence along land about to be conveyed to
Millicent D. Gossner South 66 degrees West 231.46 feet to land
formerly of Albert Sacco; running themce along said land North
24 degrees West 100 feet to a concrete monument; running thence
North 66 degrees East still along said land 231.46 feet to a
concrete monument on the westerly side of Indian Neck Lane at the
point or place of BEGINNING.
BEING AND INTEIMD TO BE a portion of the same premises conveyed
to the party of the first part and Helga E. Garbade as tenants by
the entirety by deed dated August 31, 1970, recorded September 1,
1970 in the Suffolk County Clerk' s Office in Liber 6799 of Deeds
at page 499.
SUBJECT to a mortgage dated June 3, 1971 to Southold Savings Bank •
in the original principal amount of $36,000. which mortgage was
recorded June 8, 1971 in Liber 6053 of Mortgages at page 128
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.

AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid. S
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of t
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
