THIS INDENTURE, made the 25th day of June nineteen hundred and Seventy-Four,"
BETWEEN MARGARET F. MAHAFFY, residing at 770 Leeward Drive, Southold,
New York 11971 and MILDRED F. FARDELMANN, residing at 25 Remsen
'Street, Brooklyn, New York 11201, as Joint Tenants
party of the first part, and MILDRED F. FARDELMANN, residing at 25 Remsen Street,
Brooklyn, New York 11201
party of the second part,
WITNESSETH, that the party of the first part, in consideration of ten dollars paid by the party of the second
part, does hereby remise, release and quitclaim unto the party of the second part, the heirs or successors and
assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,�situate,
lying and being to the y

t� York, known and designated as Lot 52 on a certain map entitled,
"Map of Leeward Acres at Bayview. " and filed in the Office of the
Clerk of the County of Suffolk, on June 4, 1971 as Map No. 5599.
TOGETHER with an easement and right of ingress and egress over any
roads described in the subdivision map to and from the nearest public
road, subject, however, to the right of ingress and egress granted or
that may hereafter be granted to other owners of numbered lots on
said subdivision map and others to whom the same may be granted over
the roads and extensions on said map . Further subject to the right
of Leeward Acres at Bayview, its successors and assigns, to dedicate
the lands included therein to the Town of Southold as a public high-
way which right of dedication is hereby reserved . Upon such dedica-
tion the easement and right hereby granted shall terminate .
TOGETHER with an undivided 153rd interest appurtenant to Lot 52 in
lands shown and designated as Park, Recreation & Drainage Area on
the "Map of Leeward Acres at Bayview, Inc." filed in the Office of
the Clerk of Suffolk County on June 4, 1971 as Map No. 5599.
SUBJECT to a first mortgage held by The East New York Savings Bank
dated November 28, 1973 in the original sum of $27,000.00 covering
Lots 52 and 53 on the above described map.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with lite appurtenances `
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part,in compliance with Section 13 of the Lien Law, hereby covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement'and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of thindenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day,and year first above
written.
