HORTON, residing at (no number) Main Road, Peconic, New York, (surviving spouse of Philip H. Horton) , party of the first part, and LELAND P. BOOTH, residing at (no number) Laurel Avenue, Southold, New York, party of the second part, WITNESSETH, that the party of the first part, in consideration of ten dollars paid by the party of the second part, does hereby remise, release and quitclaim unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, !12 I lying and beingAmbe at Southold in the Town of Southold, County of Suffolk and State of ) Ii New York, bounded and described as follows: BEGINNING at a point marked by an iron pipe on the southerly side of Main Road which point is 843, 96 feet northeasterly along said southerly line of Main -) Road from its intersection with the easterly side of Bay Home Road, (Said point of beginning being also the northeasterly corner of Lot No. 7 as shown on a certain map entitled "Map of Willow Point", filed in the Suffolk County Clerk's Office as Map No. 4652); from said point of beginning running thence along the southerly line of Main Road North 59 401 00" East, a distance of 417.29 feet to a point marked by an iron pipe and land now or formerly of Morris; running thence along said land now or formerly of Morris South 180 20' 00" East, a distance of 251.0 feet to the ordinary high water mark of Budd's Pond; running thence in a westerly, southwesterly and southerly direction along the ordinary high water mark of Budd's Pond a distance of 550 feet, more or less, ;to a point which is the central line of a former gutter and which point is North 590 40' 00" East 40 feet more or less, from the easterly line of subdivision property known as Willow Point; running thence South 590 401 00" West a distance of 40 feet more or less, to the easterly line of premises shown on subdivision map of Willow Point; (which point is South 200 461 40" West a distance of 469.06 feet from the southerly terminus of the easterly line of premises herein described); running thnece North 300 201 00" West a distance of 540.0 feet to the point or place of BEGINNING. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part,in compliance with Section 13 of the Lien Law, hereby covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose.
