THIS INDENTURE, made the 30th iia; of December !,3ndrfd and seventy-five,
BETWEEN RICHARD L. HORTON, JR. and DEBRA S. HORTON, his wife,
both residing at Wells Road (no street number),
Peconic, New York,
party of the first part, and DONALD J. WALSH and pHyLLIS C. WALSH, his wife,
both residing at 186 Wetherill Road, Garden City, New York,
party of the second part,

or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with tbt baiLoi"4 and irr.rrovzm-tits thereon erected, situate,
lying and beingAKft at Peconic, Town of Southold, County of Suffolk and
State of New York, bounded and described as follows :
BEGINNING at a concrete monument set on the curved northerly line
of Wells Road at the point where the boundary line between land
of Antone Skwara and land formerly of Charles J. Simon intersect
said northerly line, being the southeasterly corm r of said land
of Antone Skwara and the southwesterly corner of the premises
herein described, and which were of Charles J. Simon; from said
point of beginning running along said land of Antone Skwara,
North 21 degrees 21 minutes 10 seconds West a distance of 207. 10
feet to a point;
RUNNING THENCE in a general easterly direction along other land
formerly of Edward B. Terrill and wife, and now or formerly of
Zaiser, North 84 degrees 56 minutes 50 seconds East a distance
of 207. 10 feet to the westerly line of Wells Road;
RUNNING THENCE in a general southerly and southwesterly direction
along said Wolls Road on a curve to the right having a radius of
207. 10 feet, a distance along said curve of 266.39 feet to the
point or place of BEGINNING.
SUBJECT to covenants, reservations, easements and agreements of
record, if any, and SUBJECT to any state of facts that an accur-
ate survey may show.
SUBJECT to a first mortgage held by the North Fork Bank & Trust
Company in the original sum of $22, 500. 00, now reduced to the
sum of $21,858. 58 with interest thereon from the 1st day of
December 1975, at the rate of 8% per annum, which mortgage the
parties of the second part herein agree to assume and pay.
TOGETHER with all right, title and interest,if any, of the party, of the first part of, in and to any ,tenets and
roads abutting the above-described premises to the center lines thereof; TOGETHER with the appurtamumn
and all the estate and rights of the party of the first part an and to said premises; TO HA IM AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any wa) whatevcr, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the pulY of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvem&,i, bef�! using any part of the total of the saw lot
any other purpose.
