his wife, the grantors herein, dated November 1, 1969 and recorded
it November 17, 1969 in the Suffolk County Clerk' s Office in Liber

5726 at page 426, and mortgage dated the 28th day of August,
1971, made by Martin Ehrenreich and Agnes Ehrenreich, his wife to
the Southold Savings Bank in the principal sum of $9, 386.14 and
recorded in the Suffolk County Clerk' s Office in Liber 6135 at page

188 on September 8, 1971, which said mortgage contained a statement
consolidating it with the first mortgage set forth so that the two
constitute a single valid first lien on the premises described
therein. The present remaining principal balance on said consolidated
mortgage is $22, 518.15.

AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.

AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
j The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
