WITNESSETH,that the party of the first part, to whom letters testamentary were issued by the Surrogate's Court, Nassau County, New York on February 26, 1974 and by virtue of the power and authority given in and by said last will and testament, and/or by Article 11 of the Estates, Powers and Trusts I,aw, and in consideration of h' in partial satisfaction of the residuary devise contained in the Last Will and Testament of Raymond E. Smith, owner, scale 1 " to 801 made by Franklin F. Overton, M.E. Surveyor, 1912, and filed in Suffolk county Clerk's Office, on the 27th day of May, 1913, and numbered 551 and bounded as follows: - Easterly by a two rod road laid down on said map 100 feet; Northerly by Lot 33 on said map 198.2 feet on a line running South 79 degrees 371 W. to land of the Heirs of Samuel Davids deceased; Westerly by land of the heirs of Samuel Davids, deceased, 100.2 feet, and Southerly by Lot F. on said map 205.2 feet on a line parallel with the ; northerly line of theses premises and 100 feet distant therefrom. Together with a right of way from the Easterly side of said premises over the two rod road laid down on said map to and from the Indian Neck Road or Highway and to and from Indian Neck Bay. AND ALSO the privilege of using the beach adjoining Little Peconic Bay and lying between the two rod road laid down on said map on the east and the land of the heirs of Samuel davids, deceased, on the west and below a line running parallel to and 80 ft, distant from present highwater mark of Little Peconic Bay for the purpose of bathing and boating and keeping boats in connection with others but not to erect any buildings or structures thereon. PREIISES INTENDED being the same premises heretofore conveyed to Raymond E. Raynis by deed dated March 30, 1949, and recorded in the office of the Clerk of the County of Suffolk in liber 2934 at page 397.
