Commencing at a point formed by the intersection of the southerly line of Opechee Avenue and the easterly line of Minnehaha Boulevard thence South 77 deg, 38' East 144 feet more or less through a Cedar stake to Corey Creek, measured along the southerly side of Opechee Avenue ; thence southerly along Corey Creek 50 feet more or less to a point ; thence North 81 deg. 50' West 141. 9 feet through a stake to a locust stake on the easterly line of Minnehaha Boulevard; thence North 3 deg. 36' West 62 feet along the easterly line of Minnehaha Boulevard to the point or place of beginning. Together with all the right, title and interest of the party of the first part of, in and to the land lying within the bed of Minnehaha Boulevard and Opechee Avenue to the center lines thereof; and in, to and under the water of Corey Creek adjacent to said premises. All right, title and interest of the party of the first part to the use of the roadways and beaches above mean high water, now owned and used by the Laughing Water Property Owners Association, assuming the party of the second part is a member of the Association. BEING AND INTENDED TO BE the same premises conveyed to the sellers herein by deed dated April 21, 1950 and recorded in the Suffolk County Clerk ' s Office on April 24, 1950 in Liber 3068 at page 23. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. -• AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
