along the southerly line of said private right of way from the cor-
ner formed by the intersection of the easterly side of Town Harbor
Lane with the southerly side of said private right of way; running
thence easterly along the southerly side of said private right of
way along the arc of a curve bearing to the left having a radius of
971. 29 feet, a distance of 150 and 58/100 feet to land now or form-
erly Thomas F. Daly, Jr. ; thence along said land of Daly South 48
degees i0 minutes ^u0 seconds ;Hast 352 .03 feet to ordinary highwater
mark of Little Peconic Bay; thence Westerly along said ordinary high
water mark of Little Peconic Bay on a tie line course and distance
of South 41 degrees 5 minutes 30 seconds West 149 . 88 feet to land
now or formerly of H.J. Fisher; thence along said land of H.J. Fisher
North 48 degrees 08 minutes 40 seconds West and passing thru a monu= .
ment 339 . 00 feet to the southerly line of the private right of way
known as Town Harbor Terrace at the point or place of BEGINNING.
TOGETHER with the non-exclusive right forever at all times to the
party of the second part, their heirs and assigns and the occupants
or grantees of said premises and they and their servants and all
other persons for them or their use, benefit or advantage to pass
or repass on foot or with vehicles over said private road herein-
before mentioned and called Town Harbor Terrace.

first part in and to the beach fronting said premises and in and
to lands under water in Peconic Bay adjacent to said premises.
BEING AND INTENDED to be the same premises conveyed by Rensselaer
G. Terry, Jr. , as executor of the last will and testament of Irene
G. Henderson, deceased, to Walter F. Keenan by Deed dated November
30, 1961 and recorded in the Office of the Clerk of Suffolk County
on February 28, 1962 in Liber 5132 at Page 144 . -

ROBERT C. VAN DERVEER, being duly sworn, deposes and says:
That he is a Title Closer engaged by The Title Guarantee
Company. d
That on July 1, 1975 he attended and supervised the convey-
ance of title to certain premises situated in the Village of
Southold, Town of Southold, in the County of Suffolk and State of
New York, by Deed of WALTER F. KEENAN, dated July 1, 1975, and
given to JENIFER HEYWARD, upon the payment of the consideration
therefore, which Deed is offered for recordation herewith.
That deponent knows of his own knowledge that the consider-
ation for the said conveyance was $185,000.00, and that same con-
sisted of cash in the amount of $142,820.90, and by the assumption
by JENIFER HEYWARD of a certain Mortgage, dated August 17, 1971,
made by WALTER F. KEENAN III, given to SOUTHOLD SAVINGS BANK, in
the original amount of $45,000.00, which Mortgage was duly record-
ed in the Clerks Office of Suffolk County on September 9, 1971,
in Liber 6136 of Mortgages at Page 443, upon which there remained
unpaid the principal amount of $42,179.10, as of July 1, 1975
That the Deed Tax tendered for recordation herewith is based
upon the Grantors equity of $142,820.90, at the time of his con-
veyance of the premises .
Attached hereto and made a part hereof is a copy of assump-
tion statement, dated June 16, 1975, issued by SOUTHOLD SAVINGS
BANK, relating to their Mortgage aforesaid, and certifying the
principal balance of their Mortgage to be in the amount of
$42,179.10, as of July 1, 1975
The Assumption Agreement relating to the Mortgage herein set
forth, entered into by and between JENIFER HEYWARD and SOUTHOLD
SAVINGS BANK, dated June 25, 1975, and offered for recording

simultaneously with the Deed aforesaid, fully substantiates the
facts as set forth herein.
Wherefore deponent respectfully requests that the Deed here-
with be accepted for recordation upon the payment of Deed Tax in
