SCHNEIDER late of age,cage, . .Y'. deceased, z party of the first part,and DOLORES BORKOWSKI, presently residing at j> 55 Sunset Drive, Centereach, N.Y. l ..� party of the second part, r C'7 WITNESSETH, that the party of the first part, by virtue of the power and authority given in and by said last L J will and testament,and in consideration of FORTY-SEM 'THOUSAND FIVE HUNDRED and no/100 ( 4`/5nu.n0J--------------------------------------------------------dollars, paid by the party of the second part,does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being bmdm at Laughing Water., Town of Southold, County of Suffolk and State of New York, bounded and described as follows: V ,l BEGINNING at a point on the northerly side of Minnehaha Boulevard, distant 99.7 feet easterly from the corner formed by the intersection of the easterly side of Owaissa Avenue with the northerly side of Minnehaha Boulevard; running thence along the northerly side of 14innehaha Boulevard, the following two courses and distances: (1) SOUTH 61 degrees 23 minutes EAST, 63.30 feet; (2) SOUTH 54 degrees 15 minutes EAST, 34.70 feet; thence NORTH 58 degrees 42 minutes EAST, 112 feet more or less to the mean high water line of Corey Creek; thence WESTERLY along mean high water line of Corey Creek, 117.50 feet more or less; thence SOUTH 45 degrees 14 minutes WEST, 125 feet more or less to the northerly side of Minnehaha Boulevard, the point or place of BEGINNING. BEING and intended to be the same premises conveyed to HOWARD 0. SCHNEIDER and ELIZABETH G. SCHNEIDER, his wife, by deed dated October 4, 1952, recorded in Liber 3421 cp 211 and by deed dated September 6, 1955, recorded in Liber 5563 cp 275• TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and I' roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances, and also all the estate which the said decedent had at the time of decedent's death in said premises, and also the estate therein, which the party of the first part has or has power to convey or dispose of, whether individ- ually, or by virtue of said will or otherwise; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been incumbered in any way whatever, except as aforesaid AND the party of the first part,in compliance with Section 13 of the lien law, covenants that the party of the first partwill receive the consideration for this coveyance and will hold the right to recAve such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purposes The word "party" shall be construed as if it read "parties" whenver the sense of this indenture so requires.
