Box 617 Cutchogue, N.Y. 11935 RE: RICHARD PRIETO, JR. 2650 MINNEHAHA BLVD., SOUTH OLD SCTM# 87 -3-45.1 & 46 Dear Mr. Fitzgerald: The following action was taken by the Southold Town Board of Trustees at their Regular Meeting held on Wednesday, February 14, 2007: RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to Permit # 6294 to remove 113' of existing wood-sheathed bulkhead and 35' of concrete/stone/wood return/retaining wall, and construct a new vinyl bulkhead of the same dimensions immediately landward of the existing bulkhead. The old bulkhead will remain in place until the new bulkhead is completed. Rebuild existing fixed walkway making it 2' long on the seaward end, and replace existing ramp with a ramp 2' shorter. The location of the existing 6'X 20' float will be unchanged; the location of the two existing 2-spile dolphins will be unchanged; the overall length of the dock will be unchanged. Rebuild existing 4'X 4' cantilevered platform in the same location and all as depicted on the plan prepared by Proper-T Permit Services revised February 1,2007. TERMS AND CONDITIONS The Permittee, Richard Prieto, 2650 Minnehaha Blvd" Southold , as part of the consideration for the issuance of the Permit does understand and prescribe to the following: I. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of South old. 2. That this Permit is valid for a period of 24 months, which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of South old require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy ofthis Trustee permit has been recorded with the Suffolk County Department of Real Properties Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety (90) calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. . . James F. Box 617 Cutchogue, NY 11935 Re: RICHARD PRIETO 2650 MINNEHAHA BLVD., SOUTHOLD SCTM# 87-3-45.1 Dear Mr. Fitzgerald: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, February 15, 2006 regarding the above matter: WHEREAS, Proper-T Permit Services as agent for RICHARD PRIETO applied to the Southold Town Trustees for a permit under the provisions of Chapter 97 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated January 25,2006, and WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on February 15, 2006 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the proposal complies with the standards set forth in Chapter 97 of the Southold Town Code, 2 . . WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, THEREFORE BE IT RESOLVED, that the Board of Trustees approve the application of RICHARD PRIETO to remove 113'+/- of existing wood-sheathed bulkhead and 35'+/- of concrete/stone/wood return/retaining wall and replace in same location with the same structures using vinyl sheathing. Rebuild existing fixed walkway making it 2'+/- longer on the seaward end, and replace existing ramp with a ramp 2'+/- shorter. The location of the existing 6'X 20' float will be unchanged; the location of the two existing 2-pile dolphins will be unchanged; the overall length of the dock will be unchanged. Rebuild existing 4'X 4' cantilevered platform in the same location with the condition that a 15' non-turf buffer be landward of the bulkhead and all as depicted on the plans prepared by Proper-T Permit Services revised July 10,2006. Permit to construct and complete project will expire two years from the date the permit is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Inspections are required at a fee of $50.00 per inspection. (See attached schedule.) Policy 3 Enhance visual quality and protect scenic resources throughout the Town of Southold. lilES 0 NO 0 NOT APPLICABLE The bulkhead replacement structure and the modified dock structure proposed are both oflow profile, as are the existing structures, and will be inconspicuous in the proposed location. They are is compatible with other existing shoreline structures in the area, and will not adversely affect the dynamic landscape elements (tidal fluctuations, seasonal vegetation changes; seasonal/diurnal changes in ambient light) which might contribute to ephemeral visual qualities. Policy 4 Minimize loss of life, structures, and natural resources from flooding and ero- sion. ~S o NO 0 NOT APPLICABLE It is intuitively obvious that the likelihood of the structures proposed contributing to increased hazards which could result in the loss of life is probably non-existent. The proposed bulkhead replacement will have a significant positive effect on the protection of structures and natural resources from flooding and erosion in that the existing bulkhead, which currently provides those features, is tending toward fail- ure and its replacement is required in order that these protective features continue in effect. Policy 5 Protect and improve water quality and supply in the Town of Southold. "YES 0 NO 0 NOT APPLICABLE The proposed dock modification project will not include a pump-out station nor will liquid or solid wastes be discharged into the water or wetlands. Disturbance of the creek bed during construction and thereafter during active use of the structure will be minimal. The proposed bulkhead replacement project will minimize any wash-out of soil or sand through the bulkhead by eliminating openings in the bulkhead and by the in- clusion of a suitable marine filter cloth behind the proposed structure. Disturbance of the creek bed seaward of a line parallel to the bulkhead and ten feet from the bulkhead during construction of the structure will be minimal, and after construc- tion is complete there will be no effect. The use of vinyl sheathing to replace the existing wood structure will eliminate the possibility of potentially harmful chemi- cals leaching from treated wood. Policy 6 ~S . . Protect and restore the quality and function of the Town of Southold's ecosys- tem. o NO 0 NOT APPLICABLE Although the shading resulting from both the existing and the modified dock may adversely affect the wetland vegetation immediately under it, efforts will be made in the construction to space the deck planking to permit some sunlight through. During construction, any indigenous plants will be protected insofar as possible. All statutory and regulatory requirements, at all levels of government, will be strictly complied with. No dredging, excavating, or filling is associated with the dock modification. During construction, any indigenous vegetation will be protected insofar as possi- ble. The walkwav will pass through an existing unvegetated area at the shoreline. All statutory and regulatory requirements and, in addition, all conditions imposed by regulatory agencies, at all levels of government, will be strictly complied with. The project is located in a Significant Coastal Fish and Wildlife Habitat, although Corey Creek has been so designated, the proposed project is not inconsistent with Policy 7 of the NYS CMP. Dredging is not proposed in the main body of the creek, but may be necessary within ten feet of the proposed replacement bulkhead in or- der to restore the bottom to its pre-project level. The only structural intrusion into the wetlands will be minor changes in the existing dock: the construction of a re- placement for the fixed walkway with a shortened ramp to the existing floating dock, all of which now totals less than XXX square feet below the ordinary high water mark. The western shore of Corey Creek in the project area is developed with private wa- terfront residences, and the three properties immediatelv adiacent to the proiect area to the north and the two properties to the south all have existing dock struc- tures similar to that proposed. . There will be no incremental increase in shoreline development attributable to the proposed project, and it is not significant from the standpoint of a potential adverse impact upon wildlife, shellfish or finfish. The bottom in the immediate area of the proiect is not conducive to scallop or clam production. The area above the high water mark is not suitable for least tern or pip- ing plover nesting, and there are no osprey nesting sites in the immediate area. Diamondback terrapin have not been observed in or near the project location. The project will have no adverse effect upon existing tidal patterns and there will be no degradation of water quality. ~: Policy 8 ~S . . Protect and improve air quality in the Town of Southold.
