Box 578 Southold, NY 11971 RE: 375 LIGHTHOUSE LANE, SOUTHOLD SCTM#70-6-29.2 Dear Mr. Poller: The following action was taken by the Southold Town Board of Trustees at their Regular Meeting held on Wed., February 16, 2011: RESOLVED, that the Southold Town Board of Trustees APPROVES the Amendment to Wetland Permit #6503 to install a 12' wide ramp through the 10' non-turf buffer landward of the bulkhead and extended 19' landward of the buffer, using non-treated lumber or grated fiberglass decking with 3/8" spacing, and as depicted on the plan received on January 26, 2011 and stamped approved on February 16, 2011. This is not a determination from any other agency. The contractor submitted a notice of completion with the NYS DEC but did not know of any form or notification process to the Town. The transition grade of the non turf buffer to the bulkhead and existing dock is steep. The grade drops 1.5 feet over 10 feet resulting in a 9 degree grade. It is somewhat difficult navigate under the best of circumstances. It is nearly impossible for my wife, who is permanently disabled as a result of a car accident, to transit. (She has had a permanent Handicapped parking sticker since 1992). i've tried several solutions to make the transition more manageable. Stepping stones have improved the footing, but if there are any pebbles or sand on the stones, it is like trying to walk on ball bearings. You office staff recommended that I request a modification of the bulkhead permit. I would like to either install a ramp on the non turf buffer or put in several steps to make the grade more manageable. Both options would keep the non-turf buffer intact. I think either solution would improve the safety of transiting the non turf buffer to the bulkhead and dock. Enclosed is a check in the amount of $50 for the permit modification request. TERMS AND CONDITIONS The Permittee, Fred Pollert, 375 Lighthouse Lane, Southold, as part of the consideration for the issuance of the Permit does understand and prescribe to the following: That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said perrmttee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. That there will be no unreasonable interference with navigation as a result of the work herein authorized. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Department of Real Properties Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety (90) calendar days of issuance of this permit. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. That the Pennittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. James F. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP. Pursuant to Chapter 268, the Board shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. DEVELOPED Policy I COAST POt/CIES Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. The existing bulkhead on this property is beginning to fail. The owner has made effort to patch certain areas of this structures but a new bulkhead is needed. The owner would like to build a new bulkhead directly in front of the existing bulkhead so that the creosoted preservative is not disturbed and allowed to enter the waterways. It is believe that more damage will be done if the existing bulkhead is remove than to build a new bulkhead directly in front essentially burying the existing bulkhead. Policy 2 Preserve historic resources of the Town of Southold. This property has no significant historic resources. Policy 3 Enhance visual quality and protect scenic resources throughout the Town of Southold. The bulkhead at this location is existing. The present condition of this bulkhead is becoming unstable threatening the integrity of the upland property. As the photos show there are small sump holes which will become larger and more apparent as this bulkhead ages. A new bulkhead is just an attempt of the upland property owner to maintain his property. There is an existing bulkhead so the visual quality and scenic resources will remain the same. NATURAL COAST POL~CZES Policy 4 Minimize loss of life, structures, and natural resources from flooding and erosion. The existing bulkhead is needed to protect the upland property. The new bulkhead will not increase flooding or erosion in this area. Policy 5 Protect and improve water quality and supply in the Town of Southold. This proposal will not have any impact on the water quality and supply of the Town of Southold, Policy 6 Protect and restore the quality and function of the Town of Southold's ecosystem. There is a bulkhead presently existing and we are proposing to construct a new bulkhead immediately in front of the existing bulkhead. This structure will extend no more than 18" seaward of the existing bulkhead. This property is used by the upland property owners to engage in water dependent activities such as boating, fishing and swimming. These activities will continue at this site. Policy 11 Promote sustainable use of living marine resources in the Town of Southold, During the initial construction there will be a slight disturbance. Once construction is complete, the area will be allowed to re-establish itself which will take normally one complete season.
