Box 356 Cutchogue, NY 11935 RE: 65390 ROUTE 25, SOUTHOLD SCTM# 53-5-2 Dear Mr. Filipkowski: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, August 24, 2005 regarding the above matter: WHEREAS, KAROL FILIPKOWSKI applied to the Southold Town Trustees for a permit under the provisions of Chapter 97 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated June 17, 2005, and WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on August 24, 2005 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS; the structure complies with the standards se~~ortfi in UFiapter 97 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, 2 RESOLVED, that the Board of Trustees approve the application of KAROL FILIPKOWSKI to construct asingle-family dwelling, septic system, and pervious driveway with the conditions of the restoration/ planting of a 50' buffer to the east, a haybale line along Tarpon Drive, gutters and drywells to contain roof runoff, and all as depicted on the plan surveyed by John Metzger of Peconic Surveyors last dated Sept. 16, 2005. Applicant must submit arestoration/planting plan to create a buffer to the fresh water wetland area to the east of the parcel. The buffer will be a 50' from the property line and be mostly Red Maples (Acer rubrum), at least 10' - 12' tall, 2 1/2 - 3" 25 gallon trees, (October Glory is available from local nurseries), on 15' centers. It g 3E' `'a counter-intuitive name from the fact that it is always the first fern species to die with th Spicebush (Lindera benzoin) The fragrant leaves, branches and bright red berries of this moist-soil shrub provide v Fish food and cover for songbirds and other wildlife. Birds Invertebrates Clasping-leaved Pondweed (Potamogeton perfoliatus) Amphibians This submerged aquatic plant inhabits slow moving sections of the Hudson River and Mammals tributaries, where it helps filter the water, provides food for waterfowl, and lends esse Plants to young aquatic organisms. Water Celery (Vallisneria americans) Arguably the most important food source for migrating waterfowl in the Hudson Valley submerged aquatic plant has leaves that can reach up to 7 feet from the murky botto Hudson towards sunlight. Wild Rice (Zizania aquatics) Once a favorite food of local natives, this 10-foot tall wetland plant is stilt a favorite fo Hudson River wildlife. Swamp Rose-mallow (Hibiscus moscheutos) This 6-foot tall plant has huge, light pink flowers and is found most commonly in the b waters south of the Highlands. 7/15/04 Field Inspection - _ Purple Loosestrife (Lythrum salicaria) Despite the beauty of its large purple flower spike, Loosestrife has become one of the popular plants of the Hudson wetlands because, like many introduced species, it com against more valuable native species. Narrow-leaved Cattail (Typha angustifolia) This familiar wetland plant provides valuable food and habitat for wetland lovers such muskrats and red-winged blackbirds. Common Reed (Phragmites australis) This tall, feathery flowered reed has become the dominant plant of Hudson River wet the dismay of wildlife enthusiasts because it offers little cover or food for animals. It is efficient at removing excess nutrients from the water because it grows so quickly in s stands. Jewelweed (Impatiens capensis) This common wetlands herb, with its beautiful flowers, gets its alternative common na Touch-me-not, from the seed pod that explodes at a touch to scatter the seed. Based upon the information provided on the LWRP Consistency Assessment Fonn submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is generally CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided that the following standard best management practices are implemented. 1. Require water quality protection measures for aeeas generating runoff (gutters, downspouts, dry wells and pervious driveways) post construction. To further Policy 5 and protect surface and ground water quality and conserve water supply to the greatest extent possible it is requested that the Board require the following best management practices for landscaping and lawn establishment post construction: 1. Require native landscaping to minimize irrigation and avoid fertilizer applications. 2. Require disease-resistant and drought-tolerant plants (where possible). 3. Retain existing vegetation within non-disturbed buffers to minimize lawn areas. Pursuant to Chapter 95, the Boazd of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
