Dear Ms. Kennedy:
The Southold Town Board of Trustees reviewed the survey prepared by CME
Associates last dated August 3, 2006 and determined the proposed construction of a
single-family dwelling to be out of the Wetland jurisdiction under Chapter 275 of the
Town Wetland Code and Chapter 111 of the Town Code.
Therefore, in accordance with the current Wetlands Code (Chapter 275) and the
Coastal Erosion Hazard Area (Chapter 111) no permit is required. Please be advised,
however, that no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of
the coastal erosion hazard area as indicated above, or within 100' landward from the
top of the bluff, without further authorization from the Southold Town Board of Trustees
pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility
to ensure that all necessary precautions are taken to prevent any sedimentation or other
alteration or disturbance to the ground surface or vegetation within Tidal Wetlands
jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such
precautions may include maintaining adequate work area between the tidal wetland
jurisdictional boundary and the coastal erosion hazard area and your project or erecting
a temporary fence, barrier, or hay bale berm.
This determination is not a determination from any other agency.

Dear Trustees:
I am writing in reference to a parcel of vacant land at Right-of -way off Equestrian
Ave. Fishers Island (SCTM# 1000-009.00-09.00-022.001) Lot NO.2-Map NO 9547 filed
Aug 11,1994.
On October 20, 2006 I puIl:based this lot from my family's plI11nership of which I
was a limited plI11ner. The Town of Southold had approved this parcel for a single family
residence in 1994 at the request of my parents, now deceased The original permit sited
the house on the water side of the a private paved access road about ISO feet away and 40
feet above Hay Harbor and at this time the DEe stated my parents did not need a permit
from that agency.
I however preferred to locate my roughly 2000 square foot dwelling further away
from the water and on a 52 foot plateau with the paved access road between the house
including and the luu:bor. I requested a variance which the town approved last summer.
Mr. Richard Strouse refined the site plan( copy attached) which was approved by
Southold Country Board of Health this fall. I understand that Mr. Jim King visited the
site with Mr. Strouse on December 13, 2006 and indicated this would not be a project that
the Trustees would need to review though no mention was made that we should ask for a
letter to that effect. At my request Mr. Irving Fenner, a licensed contractor, applied for a
building permit in Janwuy 2007 but the building department returned the drawings and
circled "Trustees" on the applications check list.
I now understand that I should have asked for a letter from your office and I
apologize for any inconvenience my oversight may have caused. However if we and Mr.
King are correct that we do not need Trustee approval, I would very much appreciate a
letter or form from your office to that effect.
