interpretation adopted at our last Regular Meeting.
Also enclosed is your $400.00 check which would have been
applied to the second part of your application for variance relief.
As you know, the ZBA's formal interpretation clarified the meaning of
Section 100-242A, and therefore variance relief was not necessary.

Sirs:
The purpose of this letter is to offer my professional
opinion on the above reference project.
Mr. McCarthy owns this parcel of property which has an
existing structure on it. This structure is composed of
sereral elements. The main portion of the structure
represents the greatest percentage of value of the entire
structure. The eastern improvements (garage and attached
shed) represents no more than 25% of the total value of
the improvements.
Mr. McCarthy's intention with the filed building permit
is to alter the existing structure that has the most valve
and improve the garage and shed that currently exists.
He will be using the existing foundation, and many Of the
existing walls.
After a site observation, it is my opinion that he will not
be removing any where close to 50% of the value of the
existing structures in this process.

The attached copies were duplicated from original Building Permit
file folders and verified with the originals on Monday afternoon,
November 6, 1995. The plans were not duplicated by me and the
applicant agreed to submit duplicates of the plans stamped by tllEi
Building Department. Member Dinizio has compared the original
Building Permit set with the set he received from the applicant.
(The original Permit rolders were returned to the Building
Department. )
At the request of the Chairman (via Secretary), Building Inspector
Gary Fish has been asked to attend the ZBA hearing on Wednesday,
November 8, 1995.

Tuesday, October 24, 1995 a.m.
Both Building Inspector Gary Fish and Property Owner Tom McCarthy
were in to explain their situation on a stop work order issued by
Gary Fish. The following conversations (and my understanding) are
noted for informational purposes (for an anticipated appeal):
Gary Fish indicated he issued a stop work order on Tom McCarthy's
project because it did not conform with plans he approved and that it
exceed.s50% of the value of the building.
Tom McCarthy indicated that he feels the plan approved by the
Building Inspector was complied with because it was stamped by the
Building Department as approved under a building permit.
Gary said that the new construction exceeds 50% of the value of the
building in his opinion and would like a letter from Tom McCarthy's
engineer stating the facts if Tom does not agree with Gary. If the
building exceeds 50% of the fair value, then Gary also wants a new
building construction plan to show areas exceeding 50% of value.
Tom says the plan is no different than what was approved and that
the easterly side where the l' setback was, and is, shown to have
new wall-construction under the plan submitted & approved.
Tom indicated that he raised the old house portion and lowered it on I
the new foundation since that is where he believed the 50% of the f '
original value of the building was, and thought that preserved the . (\ J
nonconforming building that was built prior to 1957. (Gary said Tom \ t"
(should have. left the wall of the easterly side where the garage and) t:.' "

Mr. McCarthy would forward something to Gary Fish (possibly from
an engineer) to explain what has been done since he would, if
necessary, file an appeal with the Board of Appeals on what appears
to be two differences of opinion between the approved plans and the
work done and interpretation of 100-242A and 100-242B.
ZBA Secretary called Chairman on question of whether an appeal of a
stop work order is acceptable, and Chairman indicated to ZBA staff
not to accept an appeal of a Stop Work Order until it is determined
between Gary and Tom what specifically is being appealed on the
building plans. In ZBA staff's opinion, there seems to be a
misunderstandine; between what percentage was new construction
approved on the buildine; plans and what was new construction
actually built. No papers were brought or delivered yesterday for
review by Chairman, or with the ZBA on this date - probably to try
to clear up the question underscored above. No stop work order or
disapproval papers were given for ZBA by Building Inspector as yet
either.

given by an anebdment to original building permit and
additional fee was paid for same.
The portion of the residence that remains in place today
coupled with the previous foundation exceeds the fifty
(50%) percent of the value of the original structure.
