WITNESSETH, that the party of the first pan. in consideration of Ten Dollars and other
valuable consideration paid by the party of thc second pnrt, does hereby grant and release unto
the patay of the second pan, the heirs or successors and assigns of the patty of the second pan
forever.
ALL THAT CERTAIN plot, piece or parcel of land, with the buildings thereon erected,
situate, lying and being in the Town of Southold, County of Suffolk and Slate of New York.
known and designated as Lot No. 2 as shown on a certain map entitled 'Map of Crown Land
Lane" and filed in the Office of the Clerk of the County of Suffolk on August 27, 1973 as
Map Number 6289, said lot being more particularly bounded and described as follows:
BEGINNING at a point on the southwesterly side of Crown Land Lane where the same is
intersected by the division line between Lots 1 and 2 on the above mentioned mnp. said point
being also the southeast comer of the premises about to be described herein;
RUNNING THENCE from said point or pl~ of beginning along the division line between
Lots I and 2 first above mentioned, South 64 degrees 59 minutes 00 seconds West, 269.75
feet to land now or formerly of Ann H. Grathwohl and Rich',mi W. Grathwohl;
RUNNING THENCE along said land of Ann H. Gtathwohl and Richard W, Grathwohl and
along land now or formerly of Diane Crasser and Michael R. Crasser. North 47 degrees 48
minutes 30 seconds West. 140.00 feet to the division line between Lots 2 and 3;
RUNNING THENCE along said division line. North 61 degr~."s 243 minutes 50 .~onds
East, 317.45 feet to the southwesterly side of Crown Land Lane; and
RUNNING THENCE along the southwesterly side of Crown Land Lane southeasterly along
the arc of a curve bearing to the left having a mdins of 380.00 feet a distance of 150.00 feet to
the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of thc first part
by deed dated October 11, 2002, and recorded on October 31, 2002, in the Suffolk County
Clerk's Office in Liber 12217, Page 962.
RESERVING, HOWEVER, a legal life estate in the above-described premises with the
buildings and improvements thereon erected, in and m the party of the first part.
THE PARTY OF THE FIRST PART HEREBY RESERVES A SPECIAL POWER OF
APPOINTMENT, exercisable as often as they may choose, to change their remainderman as
follows:
TO or among any one or more members of a class consisting of thc paffy of the first park's
descendants, in any degree, whether presently living or bom hcreaRer, in such proportions
and amounts, without regard m equality, outright or in trust, as thc party of the first part may
di~ct and appoint during her lifetime by properly wriffan and acknowledged instrument, and
recorded prior to death, making specific r~fercnee to this power of appointment. Thc party of
the first part may not appoint themselves, their estate, their creditors or thc creditors of their
estate, under any circumstances.
TOGETHER with all right, title and imerest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof;
TOGETHER with the appurtenances and all the estate and rights of the party of thc first part
in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the
party of the second part, the heirs or successors and assigns of the party of the second part
forever.
AND the party of the first part covenants that the party of the first part has not done or
suffered anything whereby the said premises have been encumbered in any way whatever,
except as aforesaid.
AND the pasty of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the
right to ~ceive such consideration as a trust fund to be applied first for the purpose of paying
the cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any oth-'r purpose.
The woM "patty" shall be construed as if it read "parties" whenever the sense of this indenture
