by the entirety, residing at 3125 Grand Avenue, Mat~tuck, New York
party of the first part, and CHARLES DAVEY UTTER, as Trustee of The Irma Judith
Utter Irrevocable Trust u/t/a dated 12! 19t !06, residing at 243 Sherman Canal, Venice,
California,.
party of the second part,
WlTNESSETH, that the party of the first part, in coosideration of Ten Dollars and other
valuable consideration paid by the party of the second part, doe~ hereby grant and
release unto the party of the second part, the heirs or successors and assigns of the party
of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements
thereon erected, situate, lying and being at lvlattituck, in the 'town of Southold, Suffolk
County, State of New York, more parlicularly described as follows:
BEGINNING at a concrete monument set on the westerly line of Grand Avenue at the
northeasterly comer of land conveyed by Robert H. Preston, A. Kenneth Monsell and
Robert Muir to Robert Muir and Helen Muir, his wife, by deed in Liber 3230 cp 09; and
running along said land conveyed to Robert Muir and Helen Muir, his wife, and passing
through a concrete monument set at the northwesterly comer of said land, South 71' 47'
00" West 219.14 feet; thence along other land of Preston, Monsell and Muir, the following
three courses and distances: ·
(1) North 18' 13' 00" West 74.07 feet;.
(2) North 57' 54' 50" East 104.87 feet;
(3) North 71' 47' 00" East 130.00 feet to said westerly line of Grand Avenue;
THENCE alo"n~ said westerly line of Grand Avenue, South 10' 56' 40" East 11313.00 feet to
the point or pla.ce of BEGINNING..
BEING AND INTENDED TO BE the same premises conveyed to the grantor herein by
deed dated October 24, 1964 from James P. Brown, Robert W. Brown, Clement T. Brmvn
and Mary M. Tyler, being the sole distributees of the Estate of Catherine E. Brown,
grantors, to George 1L Utter and Judith D. Utter, which deed was recorded in the Suffolk
County Clerk's Office on October 30, 1964 in Liber 5641 of Deeds at page 138.
TOGETHER with ail right, title and interest, if any, of the party of the first part in and to
any streets and roads abutting the above described premises to the center lines thereof;
TOGETHER with the appur~nances and all the estate and rights of the party of the first
part in and to said premises; TO HAVE AND TO HOLD the premises herein granted
unto the party of the second part, the heirs or successors and assigns of the party of the
second part forever.
AND the party of the first part covenants that the party of the first part has not done or
suffered anything whereby the said premises have been encumbered in any whatever,
except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants
that the party of the first part will receive the consideration for this conveyance and will
hold the right to receive such consideration as a trust fund to be applied first for the
purpose of paying the cost of the improvement and will apply the same first to the

payment of the cost of the improvement before using any part of the total of the same for

The word "party" shall be construed as if it read "parties" whenever, the sense of this
indenture so requires.
