This application must be filled in by typewriter or ink and submitted to the Building Department with the following:
A. For new building or new use:
1. Final survey of property with accurate location of all buildings, property lines, streets, and unusual natural or
topographic features.
2. Final Approval from Health Dept. of water supply and sewerage-disposal (S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contains less than 2/1 0 of 1 % lead.
5. Commercial building, industrial building, multiple residences and similar buildings and installations, a certificate
of Code Compliance from architect or engineer responsible for the building.
6. Submit Planning Board Approval of completed site plan requirements.
B. For existing buildings (prior to April 9, 1957) non-conforming uses, or buildings and "pre-existing" land uses:
I. Accurate survey of property showing all property lines, streets, building and unusual natural or topographic
features.

SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application
and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on
the environmenlif the project is implemented as planned.
PROPERTY FACTSIDESCRIPTION: The applicants' 10,275 sq. ft. parcel has 50 ft. frontage along the east
side of Strohson (private) Road in Cutchogue, and is improved with a single-family, 1-1/2 story frame dwelling
with attached garage and deck, as shown on the July 18, 1995 survey, amended July 31, 1995 by Roderick
VanTuyl, PC.
BASIS OF APPLICATION: Building Department's June 2, 2004 Notice of Disapproval, citing Sections 100-
242A and 100-244B, in its denial of a building permit with rough sketch, for a proposed addition and alterations
to an existing dwelling, shown on the rough sketch to be 5 feet for a single side yard and total 23 feet for both
side yards. The reason stated in the denial is that the additions and alterations will constitute an increase in
the degree of non-conformance, citing Code Section 100-244 which requires a minimum single side of 10 feet
and total Side yard area of 25 feet.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on August 19, 2004 at which time written
and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the
property, and other evidence, the Zoning Board finds the following facts to be true and relevant:
AREA VARIANCE RELIEF REQUESTED: Applicants wish to construct a two-story addition to their home,
shown on the applicant's plot plan at 18+- feet from the southerly side line, and total side yards at 21+- feet,
squaring off the corner near the step area and maintaining the same setbacks of the existing dwelling.
ADDITIONAL INFORMATION: The July 31, 1995 survey prepared by Roderick VanTuyl, P.C. shows the
northerly side setback at 5 feet from the north side, and 14 feet from the southerly side at its closest point to
the stairs. When measured using the surveyor's scale, the setback of the existing wall of the dwelling is 17+-
feet, resulting in total side yard setbacks of 22+- feet. No encroachment is proposed for the new addition
beyond the existing wall of the dwelling at these setbacks.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal
Inspections, the Board makes the following findings:
1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a
detriment to nearby properties. The dwelling has existed with its present nonconforming setbacks for many

years. The purpose of the addition is to move two existing bedrooms and a bath to the second floor, add a
dining room and den area as well as a code-compliant staircase, and for new garage space. The new two-
story addition will not encroach further than the existing nonconfomning side yard and will maintain the existing
building setback lines.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to
pursue, other than an area variance. This is the smallest lot in the immediate area. Without a variance, the
addition is not possible.
3. The variance granted herein is substantial. The code requires a minimum of 25 feet for both side yards,
and the addition is a two-ft. reduction from this requirement, resulting in total side yards of 22+- feet.
4. The difficulty was self-created and is related to the need for modified living floor area, with a plan that was
designed without conforming to the current Town Code requirements.
5. No evidence has been submitted to suggest that a variance in this residential community will have an
adverse impact on the physical or environmental conditions in the neighborhood. The additions are landward
of the existing building, all of which are landward of the 10ft. elevation contour (above-mean-sea level).
6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy
the benefit of an addition and alterations, while preserving and protecting the character of the neighborhood
and the health, safety and welfare of the community. .
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under
New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Chairwoman Oliva, and
duly carried, to
GRANT the variance as applied for, as shown on the elevation and plot plans with a July 2, 2004 ZBA
date stamp.
This action does not authorize or condone any current or future use, setback or other feature of the subject property that
may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this
action.

To Whom It May Concern:
I have reviewed the plans, made several inspections
for the above mentioned residence in respect to this permit
and note the following. The insulation, fire nad perimeter
caulking, the 5/8" plywood sheating on the new walls and
roofing, both on 16" centers and strapping for s partially
enclosed building as per R 301.2.1.2 partially enclosed
structures. This building meets or exceeds the requirements
of the Southold Town Building and the New York State Building
Codes.

ANALYSIS OF CODE REQUIREMENTS FOR
WIND-BORNE DEBRIS REGIONS

These comments, by Codes Division staff, are presented at the request of Raymond Andrews,
Assistant Director for Code Development. They are not intended to offer any opinion hut rather to
provide factual information on the application of the Residential Code of New Yark State as it
applies to huildings located in wind-borne debris regions.
STAFF COMMENTS
The Codes Division has received many questions and comments rclated to the provisions of
the Residential Code of New York State (RCNYS), as it applies to the protection of windows in
buildings located in wind-borne debris regions, and the difficulty of compliance. The reasons for
these hardships usually include the cost and availability of specialized windows and complications
with insurance companies and window manufacturers concerning the installation of shutters.
Section 301.2.1.2 of the RCNYS reads as follows:
gR301.2.1.2 Internal Pressure. Windows in buildings located in wind-borne debris regions
shall have glazed openings protected from wind-borne debris or the building shall be
designed as a partially enclosed building [emphasis added] in accordance with the
Building Code of New York State. Glazed opening protection for wind-borne debris shall
meet the requirements of the Large Missile Test of ASTM E 1996 and of ASTM E 1886
referenced therein.
Exception: Wood structural panels with a minimum thickness of7/16 inch (11.lmm)
and a maximum span of8 feet (2438mm) shall be permitted for opening protection
in one- and two-story buildings. Panels shall be precut to cover the glazed openings
with attachment hardware provided. Attachments shall be provided in accordance
with Table R301.2.1.2 or shall be designed to resist the components and cladding
loads determined in accordance with the provisions of the Building Code of New
Yllrk Slate.
It is important to note that section R301.2.1.2 provides three (3) options. The Erst two
involve the protection of windows by installing either specialized glazing or protective wood
structural pancls. The third option allows the building to be designed as pmtially enclosed, without
the need for impact resistant glazing or shutters. This design procedure accounts for the increased
internal pressure that would occur as a result of shattered glazing in the event of hurricane wind
force. This procedure, although new for the Uniform Fire Prevention and Building Code, is not
unique in that it is based on a national design standard referenced by the Building Code of New York

State and published by the American Society of Civil Engineers (ASCE) as "Minimum Design Loads
for Buildings and other Structures", ASCE 7-98.
Since the adoption of the building code, the number of questions concerning glazed opening
protection for buildings in wind-borne debris regions have been more numerous than other code
related issues. These questions have come from code enforcement officials, engineers, architects,
contractors, suppliers, and homeowners. In nearly all cases, they have not been aware of the option
to design a stnlcture as a partially enclosed building and made the assumption that all glazed
openings were required to have either specialized glazing or be protected with precut wood structural
panels. Calls from engineers and architects have also shown that they are not typically aware of the
partially enclosed building design option.
The Codes Division is responsible for the review and approval of all factory manufactured
residential construction pursuant to 19NYCRR Part 1209. To date not one of the more than 50
designs from more than 30 manufacturers we have reviewed for compliance with the new RCNYS
have utilized the option to design as a partially enclosed building. All designs utilize either impact
resistant glazing or protective panels to address wind-borne regions disregarding the third alternative.
We believe that they may not be aware of this design option.
The design procedure for partially enclosed buildings assumes that glazing is shattered during
a high wind event allowing an increased internal pressure to be imposed against exterior walls and
roof construction. This force adds' to the external uplift force imposed against the roof and lateral
force imposed against the walls. This could require strengthening of framed exterior walls and
additional strapping for roof rafters.
Codes Division staffhave performed rough calculations on a typical two-story home with
a 300 roof pitch to approximate the impact the design of a partially enclosed building would have
on typical construction. The following conclusions are made based on our preliminary analysis:
1. There would be little or no impact on the design of the main wind force resisting
system (MWFRS) of a building structure.
2. Connections would be affected, especially tiedowns for roof framing. As an
example, if a design would normally require 25 gage strapping with four 8d nails to
connect each rafter to wall framing, it would now require 20 gage strapping with six
8d nails.
3. To prevent uplift of roof sheathing, rafter spacing would need to be reduced to ] 6
inches on center from 24 inches, or the sheathing thickness could be increased by up
to 1Ie-inch.In addition, the number offasteners for sheathing attachment would need
to be increased. One-half inch plywood on rafters spaced 24 inches on center should

be acceptable.
4. Loads on subassemblies (roofframing, walls) would be increased by approximately
50%. However, the impact on the construction could be limited as follows:
. Walls- Conventional walls composed of2x4's spaced 16 inches on center,
having a floor-ceiling height of 8 feet, would be capable of resisting the
increased load. Walls composed of2x6's spaced 24 inches on center, having
a floor-ceiling height of 10 feet, would also be capable of resisting the
increased load.
. Roof Framing (Rafters or Trusses)- There would be no impact on roor
framing members, except for spacing, because the framing will already be
designed to resist minimum snow loads which would govern the design.
s. Exterior walls surrounding 2-story open interior spaces will continue to require
engineered design.
In summary, the code docs not explicitly require glazed openings to be equipped with
protective wood structural panels or costly specialized windows. Instead, these options are available
if the building is not designed as a partially enelosed structure.

SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application
and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on
the environment if the project is implemented as planned.
PROPERTY FACTS/DESCRIPTION: The applicants' 10,275 sq. ft. parcel has 50 ft. frontage along the east
side of Stroh son (private) Road in Cutchogue, and is improved with a single-family, 1-1/2 story frame dwelling
with attached garage and deck, as shown on the July 18, 1995 survey, amended July 31, 1995 by Roderick
VanTuyl, P.C.
BASIS OF APPLICATION: Building Department's June 2, 2004 Notice of Disapproval, citing Sections 100-
242A and 100-244B, in its denial of a building permit with rough sketch, for a proposed addition and alterations
to an existing dwelling, shown on the rough sketch to be 5 feet for a single side yard and total 23 feet for both
side yards. The reason stated in the denial is that the additions and alterations will constitute an increase in
the degree of non-conformance, citing Code Section 100-244 which requires a minimum single side of 10 feet
and total side yard area of 25 feet.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on August 19, 2004 at which time written
and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the
property, and other evidence, the Zoning Board finds the following facts to be true and relevant:
AREA VARIANCE RELIEF REQUESTED: Applicants wish to construct a two-story addition to their home,
shown on the applicant's plot plan at 18+- feet from the southerly side line, and total side yards at 21 +. feet,
squaring off the corner near the step area and maintaining the same setbacks of the existing dwelling.
ADDITIONAL INFORMATION: The July 31, 1995 survey prepared by Roderick VanTuyl, P.C. shows the
northerly side setback at 5 feet from the north side, and 14 feet from the southerly side at its closest point to
the stairs. When measured using the surveyor's scale, the setback of the existing wall of the dwelling is 17+-
feet, resulting in total side yard setbacks of 22+- feet. No encroachment is proposed for the new addition
beyond the existing wall of the dwelling at these setbacks.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal
Inspections, the Board makes the following findings:
1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a
detriment to nearby properties. The dwelling has existed with its present nonconforming setbacks for many

years. The purpose of the addition is to move two existing bedrooms and a bath to the second floor, add a
dining room and den area as well as a code-compliant staircase, and for new garage space. The new two-
story addition will not encroach further than the existing nonconforming side yard and will maintain the existing
building setback lines.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to
pursue, other than an area variance. This is the smallest lot in the immediate area. Without a variance, the
addition is not possible.
3. The variance granted herein is substantial. The code requires a minimum of 25 feet for both side yards,
and the addition is a two-ft. reduction from this requirement, resulting in total side yards of 22+- feet.
4. The difficulty was self-created and is related to the need for modified living floor area, with a plan that was
designed without conforming to the current Town Code requirements.
5. No evidence has been submitted to suggest that a variance in this residential community will have an
adverse impact on the physical or environmental conditions in the neighborhood. The additions are landward
of the existing building, all of which are landward of the 10 ft. elevation contour (above-mean-sea level).
6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy
the benefit of an addition and alterations, while preserving and protecting the character of the neighborhood
and the health, safety and weifare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under
New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Chairwoman Oliva, and
duly carried, to
GRANT the variance as applied for, as shown on the elevation and plot plans with a July 2, 2004 ZBA
date stamp.
This action does not authorize or condone any current or future use, setback or other feature of the subject property that
may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this
action.
