Melissa will work with Planning Board on this. LPC decided to allow two separate development rights easements, one on each of the existing lots. State language will be required on the 24± acre easement as this property has been awarded a State grant. The 5-acre lot will have a separately recorded easement. There is to be one farm access “driveway” from Oregon Road to the two easement lots. ?? Peconic Land Trust is negotiating to buy fee title to property from landowner and, in turn, proposes to sell a development rights easement to the Town. PLT will reserve 2± acres around the existing residential and agricultural structures. LPC decided to allow for further subdivision of restricted land provided that any lot line change results in creating a new lot of not less than 10 acres. ?? Landowner accepted offer and contract is being reviewed by his attorney. Landowner has requested a two acre reserved area for riding arena and stalls and LPC has agreed. LPC has requested a covenant and restriction that would prohibit the two acre reserved area from ever being residentially developed except for farm related housing. Landowner’s attorney asked for relief from this requirement. LPC reviewed and decided that this requirement was part of their decision in regard to purchase price. LPC was not in favor of change. LPC reviewed request to change requirement re: equestrian fencing to agricultural fencing. LPC in favor of this change. Agricultural fencing would be allowed subject to LPC review. ?? LPC is in favor of allowing gazebo provided a limitation on structure size, and the parking spot. This is a buildable lot and with an action of the Town to purchase a development rights easement on this lot, one residential building lot would be eliminated. ?? MOTION made by Eric Keil, seconded by Chris Baiz, to present a purchase offer to Peconic Land Trust, Incorporated for a development rights easement on the Arrieta property. There are to be no restrictions on ag structures. Further subdivision/lot line changes on this property would be permitted provided that the new lots created would result in no lot less than 10 acres in size. Motion carried: 5/0 ?? Purchase offer made by LPC was accept by landowners; however, landowners made a request that LPC members consider leaving out a reserved area (building envelope) from the easement. Landowners are willing to move forward with preservation with or without reserved area as they would like to close as soon as possible. LPC reviewed whether to allow reserve area and if so, whether to adjust purchase price. MOTION made by Eric Keil, seconded by Chris Baiz, to allow for reserved area at a new reduced purchase price. Motion failed: 3/2 Melissa to contact landowners that there was no support from LPC members for a reserved area at the existing purchase price. ??
