SUFFOLK COUNTY BARGAIN AND SALE DEED THIS INDENTURE, made the /5 day of 11'7"..../: , 1995 BETWEEN the COUNTY OF SUFFOLK, a municipal corpol-ati.on of the State of New York, having its principal office at the Suffolk County Center, Center Drive, Riverhead, New York 11901, party of the first part, and TOWN OF SOUTHOLD, 53095 Main Road, P.O. Box 1179, Southold, New York 11971, party of the second part, WITNESSETH, that the party of the first part, pursuant to Resolution Number 275-1995 adopted by the Suffolk County Legislature on March 21, 1995 and, thereafter, approved by the County Executive on April 4, 1995, in consideration of ten dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL, that certain plot, piece or parcel of land with any buildings and improvements thereon erected, situate, lying and being in the Town of Southold, County of Suffolk and State of New York, and acquired by Tax Deed on May 18, 1990, from General L. Rains, the Deputy County Treasurer of Suffolk county, New York, and recorded on May 25, 1990, in Liber 11074, Page 159 on 160, and otherwise known as and by Town of Southold, "Map of Land's End at orient Roads" Map No. 5909 Filed May 3, 1973 North x L.I. Sound, East x Land's End Realty, South x Main Road, West x Land's End Realty; and PROVIDED, however, that the party of the second part will be restricted in its use of the subject premises and will use said premises solely and exclusively for municipal highway purposes; with all right title and interest reverting to the party of the first part in the event that the party of the second part, at any time, uses or attempts to use said subject premises for other than municipal highway purposes or attempts to sell, transfer or otherwise dispose of said subject premises without said premises being used thereafter for municipal highway purposes. This covenant and restriction will run with the land and shall bind the heirs or successors and assigns of the party of the second part, TOGETHER with all right, title and interest, if any, of the party of the first part of, in and to any streets and roads abutting the above-described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. SUBJECT to all covenants, restrictions and easements of record, if any. AND the party of the first part, in compliance with Section 13 of the Lien Law, hereby covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. THE WORD "PARTY" shall be construed as if it read "parties" whenever the sense of this indenture so requires. .. , , , , ,< : 1.1 ,.11 lL0J.l , THIS Legislature, being the State Envlronmental Quality Review Act (SEQRA) Lead Agency, hereby finds and determines that adoption of this law is not an action within the meaning of the State Environmental Quality Review Act and the regulations adopted thereto. See 6 N.Y.C.R.R. Section 617.2(b)(2). The Legislature further finds and determines that even if the adoption of the local law is an action within the meanlng of SEQRA, the adoption of the law is a Type II action constituting a legislative decision in connection with routine or continuing agency administration and management, not including new programs or major reordering of priority. See 6 N.Y.C.R.R. Section 617.13(d)(15) and (21). As a Type II action, the Legislature has no further responsibilities under SEQRA 6 N.Y.C.R.R. Section 617.5(a)(1); and be it further IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first above written.
