BEGINNING at a point on the westerly side of Tuthill Road extension by the extreme
northerly end of the arc of a curve connecting the easterly side of Tuthill Road
extension and the northerly side of Mockingbird Lane;
RUNNING THENCE northerly along the easterly side of Tuthill Road extension along the
arc of a curve to the right, having a radius of 725.00 feet and a distance of 92.37
feet to a point;
THENCE North 63 degrees 14 minutes 20 seconds East, 175.00 feet~.to a point;
THENCE South 34 degrees 03 minutes 40 seconds East, 109.89 feet to the northerly
side of Mocgingbird Lane; .^
THENCE South 55 degrees 56~minutes West, along the northerly side of Mockingbird
Lane, 139.46 feet to a point;
THENCE northwesterly along the arc of a curve to the right, having a radius of 40.00
feet and a distance of 62.83 feet to the easterly side of Tuthill Road extension to
the point or place of BEGINNING.
Being and intended to be the premises conveyed by deed made by Herbert R. Mandel and
Richard Israel d/b/a DBM Co. dated August 20, 1990, recorded October 24,. 1990 in
Liber 11159 cp 153
TOGETHER with all right, title and interest, if any, of the party of the first part, in and to any streets and roads
abutting the above-described premises to the center lines tbereof; TOGETHER with the appurtenances and all the
estate and rights vd~l~.~ af~h.~firs'tpart in and to said prelnises; TO HAVE AND TO HOLD the premises herein
granted unto the par~Of'l~e second part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenaots that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consider-
ation as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
