BEGINNING at an iron pipe on the northerly line of Mill Creek Drive, 125.0
feet easterly along said northerly line and its extension westerly from the
7 extension southerly of the easterly line of Grove Road; from said point of
j beginning running along land of the Seller, North 18 degrees 37 minutes 10
seconds West, a distance of 129.03 feet; thence along said land of the Seller,
North 57 degrees 56 minutes East, a distance of 23 feet, more of less, to
cc the edge of a dredged canal; thence easterly along said edge of said dredged
01 canal, 62 feet, more or less; thence along other land of the Seller, South 4
degrees 07 minutes 10 seconds East, a distance of 121 feet, more or less,
to an iron pipe on said northerly line of Mill Creek Drive, thence westerly
along said northerly line on a curve to the left having a radius of 75.0 feet,

Said premises for the purpose of identification only are known as Lot Number
5 on a certain map entitled "Map of Mill Creek Grove, owned by Henry J. Smith,
situate at Arshamonoque, Town of Southold, Suffolk County, New York" made by
Otto W. Van Tuyl, Licensed Engineer and Surveyor, dated May 13,1947, and
which map is intended to be filed.
TOGETHER with all the right, title and interest, if any, of the Seller of, in
and to the public higtmays lying in front of and adjacent to the above described
premises and to the center line thereof.
BEING AND INTENDED to be a portion of the premises conveyed to Mary S. Bond
by deed dated September 3, 1957, and reoorded in the Suffolk County Clerk's `
Office in Liber 4360 page 317.
Together with all right,title and interest, if any, of the party of the first part in and to any streets and roads abutting
the above described premises to the center lines thereof; Together with the appurtenances and all the estate and
rights of the party of the first part in and to said premises;To Have And To Hold the premises herein granted unto the i
party of the second part,the heirs or successors and assigns of the party of the second part forever.
And the party of the first part covenants that the party of the first part has not done or suffered anything whereby the
said premises have been encumbered in any way whatever,except as aforesaid.
And the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust
fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the pay-
ment of the cost of the improvement before using any part of the total of the same for any other purpose.
The word "party"shall be construed as if it read"parties"whenever the sense of this indenture so requires.
