(631)765-1809•Fax(631)765-9064 JAN 5007 FINDINGS, DELIBERATIONS AND DETERMINATION Southold Town leleal MEETING OF DECEMBER 14, 2006 ZB File No. 5973— JOHN and ANGELA REINERTSEN Property Location: 590 Arrowhead Lane, Peconic CTM 98-2-4.1 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. PROPERTY FACTS/DESCRIPTION: The applicant's 41,815 sq. ft. parcel is undeveloped land shown as Lot 38 on the 1963 Subdivision Map of Arrowhead Cove, with 316.76 feet along the west side of Arrowhead Lane in Peconic. BASIS OF APPLICATION: Request for Variances under Sections 280-15 and 280-18 (100-30A.3 and 100-33 based on the Building Inspector's August 4, 2006 Notice of Disapproval concerning a proposed new dwelling, accessory swimming pool, and accessory (cabana) building. The dwelling will be less than 50 feet from each the front lot line and rear lot line, and the swimming pool structure and an accessory building will be in a side yard rather than the code-required rear yard. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on November 30, 2006, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant wishes to construct a new dwelling, 20' by 40' accessory swimming pool, and 12' by 25' accessory (cabana) building as shown on survey prepared by John T. Metzger, Land Surveyor dated 3/1/2000, amended 9/26/2006. The dwelling will be less than 50 feet from the front lot line, less than 50 feet from the rear lot line, and the swimming pool and accessory building will be in a side yard rather than the code-required rear yard. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties because of the proposed placement of the home. During the public hearing, the neighbors to the south were concerned about noise pollution emanating from the use of the swimmingpool. The applicants stated they would like to construct the accessory swimming pool and cabana in the rear yard, but are unable to since the rear yard diminishes with the lack of depth of the lot. The applicant's property consists of merged land that was original two one-half acre lots. By merging their property, the building density was reduced for the total width of the lot, from two separate dwelling lots to only one single dwelling lot Page 2—December 14,2006 ZB File No. 5973—John and Angora.:einertsen CTM No. 98-2-4.1 with customary accessory uses. The applicant proposes to keep a country lane look and maintaining trees. The rear yard abuts a 70-acre farm/vineyard. The front yard appears larger with the existing buffer between the proposed house location and the edge of the traveled road. The applicant are able to rotate the pool to an east/west direction, increasing the setback from the southerly adjoining lot. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The depth of the lot dictates the placement of the home as well as the front and rear yards. The property has 316.76 feet in width (north to south), and is only 124 feet deep (from east to west), leaving a narrow(24 feet)for placement of a house and accessory structures. The code defines the front and rear yards, and these designed yards are not large enough to allow for a dwelling with customary accessory buildings without an area variance. 3. The variance granted herein is substantial and the maximum reduction the Board would allow. 4. The difficulty has not been self-created. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested-relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new residence, accessory swimming pool and accessory building, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Weisman, and duly carried, to GRANT the variance as applied for, as shown on survey prepared by John T. Metzger dated 3/1/2000, revised 09/26/2006 SUBJECT TO THE FOLLOWING CONDITIONS: 1. Grant the front and rear yard reductions as applied, except that placement of the pool shall be rotated into an east-to-west location and set back a minimum of 70 feet from the southerly(side) property line. 2. The accessory storage building (referred to as a cabana)can be placed in its proposed location, 47 feet from the private road (or in the rear yard of the home adjacent to the pool), and this accessory cabana shall not exceed 12'x20' in size. The structure will be unheated and contain only a half-bath lavatory,with the door to open to the outside of the structure. An outside, open shower is permitted, as well as, electricity to the structure. The cabana shall meet the same setbacks as the pool [from the easterly/front and southerly/side lot line(s)]. 3. Both the pool and accessory structure(cabana)shall be screened from the road and from the adjoining lot to the south, by a staggered row of evergreens planted at a minimum height of five feet. These plantings must be maintained, and replaced if their functional use is compromised. 4. The maximum height of the accessory structure (cabana)shall not to exceed 12 feet. 5. The ZBA reserves the right to inspect the new construction at any time. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or surrey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code,other than such uses,setbacks and other features as are expressly addressed in this action. Our two(2)lots which were merged and now comprise a"builder's acre," were originally two 1/2 acre lots which were part of an approved subdivision,Arrowhead Cove, in 1963. By merging our lots we reduced the density of development in the subdivision while maintaining the originally stipulated 35 foot front and rear yards. The model of home we chose from the manufacturer,Acorn, is called Country Home.The building materials used will blend in harmoniously to complement the character of our community. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue,other than an area variance,because: There is no other alternative than to seek front and rear setback relief and side yard _ accessory use because the lots long and narrow dimensions necessitate the use of an elongated building plan_ The building plan minimizes the impact and usage of the front and rear yards while utilizing the lot's overly abundant side yards for accessory use. (3) The amount of relief requested is not substantial because: It is consistent with other homes in the area,and consistent with the relief most recently granted to the properties located on the east and northeast side of Arrowhead Lane.The building plan provides for 35 foot front and rear yards which were approved in the original 112 acre building lot subdivision. However,those lots are now part of a subdivision which is half as dense because two 112-acre lots were merged into one parcel throughout the subdivision. (4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The residence and accessories will occupy less than 10%of the total building lot and the remainder of the lot will remain treed to keep that"country lane"feel which attracted us to the property in the first place. The entire rear yard of our property backs up to a 70-acre farm/ vineyard with no house or yard within hundreds of feet,so it is unlikely that we will impact anyone outside of the subdivision. Additionally in the front yard,our property has a 14 foot buffer of frontage from our property line to the western edge of the road which essentially creates a 50 foot front yard. The buffer will likely never be paved since all in our association want to maintain a country lane feeling. (A recent motion to widen the road during its Spring 2006 repaving was almost unanimously vetoed.) (5) Has the alleged difficulty been self-created? The Notice will be published in the next issue of the Times Review newspaper. 1) Before November 14th: Please send the enclosed Legal Notice, with both a Cover Letter including your telephone number and a copy of your Survey or Site Plan (filed with this application) which shows the new construction area or other request, by CERTIFIED MAIL, RETURN RECEIPT REQUESTED, to all owners of property (tax map with property numbers enclosed), vacant or improved, which abuts and any property which is across from any public or private street. Use the current owner name and addresses shown on the assessment rolls maintained by the Town Assessors' Office located at Southold Town Hall, or Real Property Office at the County Center, Riverhead. If you know of another address for a neighbor, you may want to send the notice to that address as well. If any letter is returned to you undeliverable you are requested to make other attempts to obtain a mailinq address or to deliver the letter to the current owner, to the best of your ability, and to confirm how arrangements were made in either a written statement or during the hearing providing the returned letter to us; AND not later than November 15th please either mail or deliver to our office your Affidavit of Mailing (form enclosed) with parcel numbers, names and addresses noted, and furnish it to our office with the white receipts postmarked by the Post Office.
