Moreover, the existence of the building and its uses already exist. This is not a situation where the applicants seek a variance for the purpose of new construction and usage. The hardship is thus unique to the applicants' property, and could not be shared by all properties alike in the immediate vicinity. • 3, The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because of the fact that such building and its usage already exist. The number of people utilizing the applicants' premises cannot in any way be increased. Assuming it is proper for the applicants to obtain a guest cottage without a kitchen facility (which would not then constitute a dwelling as we understand the Ordinance has been interpreted), we cannot foresee an increase in persons using the facility merely because a kitchen unit has been installed. The existence or non-existence of a kitchen unit in the building can in no way change either the character of the District or the character of the agiicants' premises. Upon information and belief, other properties in the immediate vicinity of the subject premises have similar situations existing in that front yard access- ory buildings are likewise being used for guest purposes. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unnecessary HARDSHIP because it would prevent any reasonable use of the one story frame house situate on the applicants' premises, and in particular, the use and occupancy of said building as a guest cottage for compensation or otherwise. Of some consequence to this application, is the fact that said building (formerly a garage incidental to the principal dwelling on the.. premises) was completed ,as to its interior on or about August 18, 1967. On June 8, 1970, a kitchen unit was installed in the building in 'furtherance of its use as a more complete guest cottage. Presumably, the installation of the latter gave rise to the conclusion that said building constituted a second dwelling on the applicants' premises. An examination of the applicants' premises would evidence. that the property has an area of approximately 30,870 sq. ft. A division of the property for the purpose of maintaining two dwellings thereon would leave each parcel within excess of 15, 000 sq. ft.--a sum greater than that required by the existing Ordinance. By creating such a division, no further violation of the Ordinance would occur since each building on the premises was constructed and/or erected prior to the advent of the Zoning Ordinance. - - It is true, of course, that the one story frame building does not contain the living area required by the present Ordinance (850 sq. ft. ) ; however, it is to be noted that such building did in fact exist prior to the Ordinance and was thereafter only com- pleted as to its interior. To require an addition to the buildin€ to meet the present Ordinance requirements as to square footage would result in great hardship to the applicants, and would serve to defeat the purpose for which the building exists, that is, a small guest cottage. Finally, it is noteworthy that the applicants completed the interior of the building in absolute good faith and without any knowledge of the violation of any provision of the Zoning Ordi- nance.
