are to run with the land:
1. The owners of Lots 1, 2 and 3, as shown on said minor subdi-
vision plat, 'shall equally share in the improvements and maintenance
of the 'following described right of ways

RUNNING THENCE from said point of BEGINNING and along lands of said
C. P_ TUMULT. the following course and distance: South 22 ° 11 minutes

2. ,.No rights whatsoever are granted the 'owners of Lots 1 and 2
across Lot 3; specifically the 10 foot footpath shown on the afore-
said minor subdivision plat, any statements in the minor subdivision
plat approved 10/24/73 by the Southold Town Planning Board to the
conitrary -notwithstanding.
3 . The grantor agrees to improve the 30 foot right of-way in
accordance with the requirements of. the Town of Southold Building
Department, Planning Board and Zoning Board. The grantor agrees
tit) do this improvement. only when required by order of -the said Town
of Southold Building Department, Planning Board and Zoning Board.
This provision shall survive delivery of the deed, and shall be
binding 'upon the heir successors and assigns of the seller's waterfron
parcel known as Parcel 3 o the minor subdivision.
4. The grantors will make no claim to any right, title and
interest to certain present dirt driveways that may be outside the
boundaries of the 30 foot right of way on the ,subject premises,
and any use that may be made of the present dirt .driveways outside
of the 30 foot, - acorss the subject premises, shall be merely a
license_ which_ may be terminated by the -Purchasers upon construction
of a residence on premises: 1. When require& pursuant -to Paragraph
3 above; 2. When required by a lending institution; 3 At such
time as it is determined that said license is an encumbrance on
the marketability of title. This provision shall survive delivery
of the deed.
SUBJECT to .the rights of others over a 30 foot right of way running
parallel along the easterly line of the subject premises, all as -
shown on the aforesaid minor subdivision plata
