BASIS OF APPLICATION: Request for a Variance under Section 280-15 and 280-124, based on the Building Inspector's August 15, 2006 Notice of Disapproval concerning shed construction located as less than the 35 ft. minimum front yard setback allowed under Building Permit No. 31292-Z dated July 19, 2005 and ZBA #5708 issued June 9, 2005. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application has been referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning reply dated December 15, 2006 states that the application is considered a matter for local determination as there appears to be no significant county -wide or inter -community impact. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on December 28, 2006, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicants request a variance concerning the as - built addition to the existing accessory shed with a 32 feet setback instead of 35 feet from the front property line. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The existing shed is located in the perceived front yard of an interior lot with no actual frontage on a road. 2. The benne itsought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The storage shed has existed in this location for many years, and there is no apparent location on this lot that would be any more suitable to move the shed. 3. The variance granted herein is not substantial. The setbacks will remain the same with the recent addition located at 32 feet. 4. The difficulty has not been self-created. The shed has existed in this location for many years 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a modest shed, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Chairman Dinizio, seconded by Member Weisman, and duly carried, to GRANT the variance as applied for, as shown on the survey prepared 11/10/05 by Kenneth M. Woychuk and renovation plan (A-8) prepared 06/24/04 by Fairweather -Brown Design Associates Inc. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Reed Property Location: 935 Private Road 3, East Marion CTM 21-1-2 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property and r consideration in this application and determines that this review falls under the Type II category �f the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 20,020 sq. ft. parcel is 52.25 feet by 350 ft. with 75.14 feet along the ordinary high water mark of the Long Island Sound, and is located at the end of a private right-of-way referred to as Private Road 3, which extends off the west side of Rocky Point Road. The property is improved with a one-story frame dwelling (cottage), accessory shed, pump shelter, and deck, as shown on the survey prepared by Roderick VanTuyl & ,Son dated September 10, 1970, amended May 9, 1988. BASIS OF APPLICATION: Building Department's March 29, 2005 Notice of Disapproval, citing Section 100-33C in its denial of an application for a building permit to construct a proposed addition to an accessory shed. The reason stated for disapproving the application is the shed is less than 40 feet from the front yard lot line on this waterfront parcel. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on June 2, 2005 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant wishes to add 8' x 11.3' to the existing shed. The existing shed is approximately 50 sq. ft. in size and is situated 14 feet from the east property line, 28'3" to the west property line, and 40 feet from the southerly property line. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. The shed will remain one-story and for storage purposes by the owners and their family. 2. The applicant is proposing to add on to a shed that has existed in the present locations for many years for the purpose of additional storage, and it would not be feasible to move the existing shed for the purpose of gaining extra storage area. 3. The variance granted herein is not substantial. The total amount of additional non -conforming area will be 55 sq. ft. 4. The difficulty has been self-created. It is logical to add to the existing shed in the proposed location because an addition on any other side of the shed would require relocating a driveway or cutting down a nearby tree. 5. No evidence has been submitted to suggest that the relief granted will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of additional storage on their property, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above and applying the balancing test under New York Town Law 267-13, motion was offered by Member Dinizio, seconded by Member Orlando, and duly carried, to GRANT the variance as applied for, as shown on the 04/12/05 site location map prepared by Fairweather -Brown Design Associates, Inc. with the condition that the shed be used only for storage purposes.
