ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
LOT lying and being in the village of Southold, Town of Southold, County of
043.000 Suffolk and State of New York, bounded and described as follows":
Beginning at a stake set on the southwesterly line of that course
of Mill Creek Drive which runs south 68' 22 ' 40" east four (4 .0)
feet southeasterly along said line from the point of beginning
of said course; running thence in a general southeasterly direction
along said southwesterly line of Mill Creek Drive south 680 22' 40"
east a distance of 75 feet to a stake; running thence in a general
southerly or southwesterly direction along other lands of the
party of the first part south 160 07' 30" west a distance of
157. 2 feet to a stake set on that course of the northeasterly
line of Mill Creek Drive which runs north 751 20 ' west. , running
thence in a general westerly direction along the said northeasterly
line of Mill Creek Drive north 751 20' west a distance of 63.73
feet to a point of the curve to the left on said line; running,
thence northwesterly on said curve in said line, having a radius of
87 feet, a distance of 11. 27 feet to a stake running thence in a
general northeasterly direction and along other lands of the
party of the first part north 16 12' 20" east a distance of
167.71 feet to the point of place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the parties
of thefirst part by Deed dated October 19, 1978 and recorded in
the Office of the Clerk of Suffolk County on November 9, 1978 in
Liber 8529 at Page 240.
SUBJECT TO a purchase money First mortgage in the sum of $28,400. 00.
SUBJECT TO covenants and restrictions of record provided same do
not render title unmarketable.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
The party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read"parties" whenever the sense of this indenture so requires.
