RUNNING THENCE North 0 degrees 23 minutes 20 seconds West, along
said easterly line of said land, 320 .00 feet to the ordinary high
water line of Long Island Sound;
THENCE Easterly along said high water line (being a general course
South 69 degrees 55 minutes 30 seconds East) , 97. 37 feet to the
westerly line of land formerly of Lillian and Floyd Tomak, now or
formerly of Melssnest;
THENCE Along said westerly line, South 1 degree 39 minutes 40
seconds West, 315. 00 feet to the northerly side of Sound View Avenue;
THENCE North 70 degrees 33 minutes 20 seconds West, along the
northerly side of Sound View Avenue', 85.00 feet to the point or
place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to Agnes P. McGunnigle
by Claus H. Robohm by a deed of conveyance dated 11/15/73 and recorded
in the Suffolk County Clerk's office on 11/23/73 in Liber 7537 at page 7,
and correction deed dated 11/15/73 and recorded in the Suffolk County
Clerk's office on 11/23/73 in Liber 7556 at page 530, the said Agnes P.
McGunnigle being the same person as Agnes D. McGunnigle.
SUBJECT to a purchase money first mortgage in the sum of TEN THOUSAND
($10,000.00) DOLLARS made and given by the party of the second part to
the party of the first part to secure the payment of a portion of the
consideration for which this conveyance is made.
TOGETHER with all right, title and interest, if any, of the grantor to
any land lying below the waters of Long Island Sound contiguous to the
above described parcel.
{ Together with ali right,title and interest,if any,of the party of the first part in and to any streets and roads'abutting
the above described premises to the center lines thereof;Together with the appurtenances and all the estate and
rights of the party of the first part in and to said premises;To Have And To Hold the premises herein granted unto the
party of the second part,the heirsorsuccessors and assigns of the party of the second part forever.
And the party of the first part covenants thatthe party of the first part has not done or suffered anything whereby the
said premises have been encumbered in any way whatever,except as aforesaid.
And the party of the first part,in cofmpl iance with Section 13 of the Lien Law,covenants that the party of the first part
will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund
to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment
o a cost of the improvement before using any part of the total of the same for any other purpose.
