THIS INDENTURE, made the /./day of December nineteen hundred and
seventy-nine BETWEEN ALMET R. LATSON, III , residing at 125 Lincoln
c N� Avenue, Mineola, New York; EDWIN M. LATSON, residing at 67 Jorale-
� T mon Street, Brooklyn, New York; and H. GARDNER INGRAHAM, residing

Trustees under, the Last Will and Testament of HELEN M. LATSON,

Southold, New York; EDWIN M. LATSON, residing at 67 Joralemon
Street, Brooklyn, New York; THOMAS D. CONNOLLY, III , residing at
902 Keystone Avenue, Northbrook, Illinois; JOANNE S. CONNOLLY, re-
siding at 5426 South Harper Avenue, Chicago, Illinois; and
DAVID M. CONNOLLY , residing at 39 Hickory Drive, Greenwich, Connecti-
cut, parties of the second part,
WITNESSETH, the parties of the first part, to whom Letters Testa-
mentary and Letters of Trusteeship were issued by the Surrogate ' s
Court, Suffolk County, New York, on October 31 , 1972 , and by virtue
of the power granted by , and in compliance with directions contained
in, said Last Will and Testament, do hereby grant and release unto
the parties of the second part, the heirs or successors and assigns
' of the parties of the second part forever, as tenants in common in
the respective undivided interests hereinafter set forth,
1 ALL those certain plots or parcels of land together with the build-
ings and improvements thereon , described in Schedule "A" hereto
annexed and made a part hereof,
TOGETHER with all right, title and interest, if any, of the parties
of the first part in and to any streets and roads abutting the said
described premises to the center lines thereof; TOGETHER with the
appurtenances , and also all the estate which the said decedent had

estate therein, which the parties of the first part have or have
power to convey or dispose of, whether individually, or by virtue
of said Will or otherwise;
TO HAVE AND TO HOLD the premises herein granted unto the parties of
the second part, the heirs or successors and assigns of the parties
; , of the second part forever, as tenants in common with respective

PARCEL TWO:
ALL that certain plot, piece or parcel of land, with the
buildings and improvements thereon erected, situate, lying and being
at Southold, in the Town of Southold, County of Suffolk and State of
New York, consisting of a strip of land 10 feet wide now used as a
roadway and extending easterly from the westerly side of land now or
formerly of Nissen and being the existing roadway reserved in a cer-
tain deed from Frank L. Downs and others to Donald E. Tuthill, dated
February 23, 1950 and recorded in Liber 3049 of Deeds at page 362 ,
the center line thereof running three courses as follows : South 79
degrees 44 minutes East 88. 52 feet; South 76 degrees 54 minutes East
57. 85 feet; and South 71 degrees 57 minutes 40 seconds East 1. 91 feet
to the westerly line of premises described in Parcel One above and the
easterly line of land now or formerly of Nissen.
Parcels One and Two above described are SUBJECT to the fol-
lowing rights of way:
(1) Subject to a right of way in favor of Kenneth Downs, his heirs
and assigns, and the heirs and assigns of Paul Diefenbacher, 20 feet
in width to and from Youngs Avenue at the northwest corner of Parcel
one above described and extending easterly to the southwest corner of
land formerly of Diefenbacher, thence southerly upon and along the
westerly side of Parcel One to the southerly side of Parcel Two above
described and thence 10 feet in width westerly upon said Parcel Two
for passage on foot and with vehicles to the westerly side of Parcel
Two.
(2) Subject to a right of way 20 feet in width in favor of Susie
Thompson, her heirs and assigns, for passage on foot or with vehicles
to and from the land now or formerly of said Susie Thompson to and
from Youngs Avenue, said right of way being along and upon that part
of Parcel One above described north of and adjacent to said land now
or formerly of Susie Thompson.
(3) Subject to the use of a right of way heretofore granted to
Donald E. Tuthill as set forth in Deed recorded in Liber 3049 of
Deeds at page 362.
PARCEL THREE:
ALL that certain plot, piece or parcel of land, with the
buildings and improvements thereon erected, situate, lying and being
at Southold, in the Town of Southold, County of Suffolk and State of
New York, bounded and described as follows:
BEGINNING at a monument which monument is located the fol-
lowing two courses and distances from the corner formed by the inter-
section of the westerly side of Maple Avenue (private road) with the
southerly side of Main Road: (1) South 16 degrees 06 minutes 30 seconds
East along the westerly side of Maple Avenue (private road) 833. 75
feet to a monument; (2) South 84 degrees 21 minutes West 157. 9 feet
to a monument, and from said point of beginning as so located and
defined running thence South 13 degrees 01 minute 30 seconds East
along land now or formerly of Joost 337 . 09 feet to the ordinary high
water line of Town Creek; thence North 68 degrees 18 minutes 50 seconds
West on a tie line course along the ordinary high water line of Town
Creek 255. 34 feet to the easterly side of land now or formerly of
Salmon; thence North 11 degrees 15 minutes 10 seconds West along the
easterly side of land now or formerly of Salmon 234. 00 feet; thence

TOGETHER with a free and open right of way for passage on
foot and with vehicles over, across and upon an open roadway from
the above described premises to the public highway known as Youngs
Avenue or Railroad Avenue, which right of way is ten feet in width.
TOGETHER with a right of way 20 feet in width extending
along the westerly side of the above described property and along the
westerly side of property now or formerly of Harry Salmon to a right
of way which leads to Youngs Avenue along the property formerly of
Arthur T. Downs and formerly of Julia Conklin for passage on foot
and with vehicles, and over the same to Youngs Avenue.
TOGETHER with a right of way 20 feet in width for passage
for vehicles and on foot which right of way shall continue to the
north of said above right of way to the right of way heretofore con-
veyed to Susie and Rose Thompson, and over the same to Youngs Avenue.
TOGETHER with all right, title and interest of Helen M.
Latson, deceased, in and to lands under water of Town Creek adjoin-
ing said premises.
PARCEL FOUR:
ALL that lot, piece or parcel of land and improvements
thereon situate, lying and being at Southold, Town of Southold,
County of Suffolk and State of New York, bounded and described as
follows:
COMMENCING at a point being the southeast corner of the
land formerly owned by Francis D. Wells and Ethel B. Wells, his wife,
and running thence South 05 degrees 35 minutes West 20 feet to the
northerly boundary of property said to belong to the Town of Southold;
thence westerly along a fence marking the irregular northerly boundary
of said property said to belong to the Town of Southold and the south-
erly boundary of the land hereby conveyed 62. 8 feet to the point where
the westerly boundary line of said first mentioned land formerly owned
by Francis D. Wells and Ethel B. Wells, his wife, would, if continued,
intersect the said northerly boundary of said property said to belong
to the Town of Southold, thence North 10 degrees 39 minutes West 26. 6
feet to the southwest corner of the said first mentioned land formerly
owned by Francis D. Wells and Ethel B. Wells, his wife; thence South
86 degrees 28 minutes East, a distance of 61.21 feet along the south-
erly boundary of said first mentioned land formerly owned by Francis
D. Wells and Ethel B. Wells, his wife, to the point or place of
beginning, be the same several distances and courses more or less.
The said Parcel Four is intended to be the same parcel of
land 4escribed in the following two Deeds: Deed dated November 30,
1964 made by FYoi a Jennette Mulford-to-kelen M. Latson and recorded
in Suffolk County Clerk a on December 28, 1964 in Liber 5676 of
Deeds at page 94 ; and D-eed "dated beicembez 2 , 1964 made by Alice Louise
Conklin Miller to Helen M. Latson and recorded in the same Clerk's
Office on December 28, 1964 in Liber 5676 of Deeds at page 96.
