party of the second part,
WITNESSETH,that the party of the first part,in consideration of Ten Dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part; the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying_and-being at Pune Neck,_ near--Southold,-in the- Tb%m of_Southold, County of
DIST. Suffolk and State of New York, shown and designated as Jot No. 33 on a certain
1000 map entitled, "Map of Southwood", filed in the Office of the Clerk of the County of
Suffolk on November 24, 1953 as Map No. 2141.

70 SUBJECT to covenants and restrictions of record affecting said premises.
BLK. BEING AND INTENDED To BE the same premises conveyed to the grantors herein
12 by deed from Howard H. Schwarting and Elizabeth Schwarting, his wife, dated June
3, 1974, and recorded in the Office of the Clerk of the County of Suffolk in
LOT Liber 7650 cp 408 on 'June 6, 1974.

SUBJECT to a mortgage held by The North Fork Bank & Trust Co. dated June 3rd,
1974 and recorded in Suffolk County Clerk's office in Liber 7087 page 201 on June
6, 1974 on which there is nvw due the principal sum of $19,903.00 and interest,
which mortgage the party of the second part covenants and agrees to assume as
part of the consideration herein.

COUNTY
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first.part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to he applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party", shall be construed as if it read "parties" whenever the sense of this indenture so requires.
