Said premises, for the purpose of identification only, are known as
the southerly portion of Lot #12, measuring 5 feet on Mill Creek Drive
and no feet of Arshamomoque Pond, and the northerly portion of, Lot x=13,
measuring 60 feet on Mill Creek Drive. and 72 feet on Arshamomoque Pond,
( on a certain map entitled "Map of Mill Creek.-Grove, owned by Henry .I.
Smith, situate at Arshamomoque, Town of Southold, Suffolk County, New
York" made by Otto W. VanT yl, licensed surveyor, Greenport, New York,
{ dated May 13, 1947, which map is intended to be filed in the Suffolk
County Clerk' s office.
TOGETHER with all the right title and interest of, the party of the
first part of, in and to MHl Creek Drive, .lying in front of and
adjacent to the said premises to the center 'line thereof.
TOGETHER with all ;the right, ,title and interest of the party of the
first part of, in .and to :lands under the waters of and the riparian
rights to Arshamomoque Pond (sometimes-known as Mill Creek) lying
adjacent to said premises on the East thereof.
SUBJECT to any state of facts a more accurate survey may show.
SUBJECT also to the fallowing- covenants _and, restrictions:
1. - There shall be no outside toilets or outhouses erected. An
adequate septic tank or cess pool shall be erected_ancd maintained to
take care of sewage disposal.
2. -That neither the party of the second part or her heirs or assigns,
shall or wi11 manufacture, sell, or cause or permit to be manufactured
or sold on any portion of the premises hereby conveyed; any goods or
merchandise of any kind, and shall not carry on or permit to be carried
I on, on any _part of said. premises , any trade, business or profession
whatsoever, or any boarding house,
3. - That no building or structure above or 'below the ',surface, other
than public utility pipes or lines, shall be erected or constructed
within ten feet of any boundary linea
4. - No fowl, poultry, animals or livestock shall be kept on said
premises, other than domestic pets.
5. - That no dwelling costing less than $3,000.00 or Tess than 625
square feet of ground floor space shall be erected on said premises
unless plans are approved in writing by the Developer.
6. - Not more than one dwelling house shall be erected on any strip of
said premises having a frontage of less than '75 feetto80 feet per
dwelling house, measured along the medium 'high water line of Mill Greek
The said covenants as declared are to be and shall be covenants
attached to and running with the land.
The said restrictions may be released or altered by the Developer at
any time.
BEING and intended to be the same premises conveyed to Herbert H. Lake
and Flora R. Lake, his wife, by William Stanley by deed dated October
1, 1955 and recorded on October 4, 1955' in the Suffolk County Clerk= s
office at Riverhead, New York in Liber of deeds 3987 at page 71.
