(631)765-1809 •Fax(631) 765-9064 NOV 3 2006 CU 'U FINDINGS, DELIBERATIONS AND DETERMINATION Southold Town(ten MEETING OF OCTOBER 5, 2006 ZB File No.5799—Mary McCabe Property Location: 250 Anglers Road, Greenport CTM 36-2-20.1 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further SEQRA steps as planned. . PROPERTY FACTS/DESCRIPTION: The applicant's 27,000 square foot parcel is improved with one story frame house and garage, as well as two sheds. BASIS OF APPLICATION: Request for a Variance under Section 100-33 (280-15), based on the Building Inspector's August 17, 2006 Notice of Disapproval concerning a proposed swimming pool in a yard other than the required rear yard. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on September 28, 2006, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant wishes to install a 18'x36' accessory swimming pool in the easterly front yard at 63 feet from the easterly lot line and 40 feet from the southerly side lot line, as shown on the John T. Metzger July 26, 2005 survey, received and date-stamped by the ZBA September 29, 2006. This location is a correction of the previous survey (same date and preparer) submitted to the ZBA on August 25, 2006 which showed a setback at 72 feet from the easterly line and 32 feet from the southerly line. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties because this lot technically has no defined rear yard under the zoning definitions, and has two front yards and two side yards. The boundary line behind the dwelling is adjacent to an unpaved right of way. The right of way is more than 60'from the proposed swimming pool. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance because this lot has two fronts along on two streets, and the remaining yards are side yards. 3. The difficulty has not been self-created due to the fact that there is no other practical location for a pool on this property. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The pool will be located behind the house and at least 32' from the side and at least 60 feet from the easterly front line, which provides sufficient area away from adjacent neighbors. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a swimming pool, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Simon, seconded by Member Dinizio, and duly carried, to GRANT the variance as applied for, as shown on survey prepared by John Metzger, Peconic Surveyors dated 07/26/05, with ZBA date stamped September 29, 2006. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code,other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity.
