This application must be filled in by typewriter or ink and submitted to the Building Department with the following:
A. For new building or new use:
I. Final survey of property with accurate location of all buildings, property lines, streets, and unusual natural or
topographic features.
2. Final Approval from Health Dept. of water supply and sewerage-disposal (S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contains less than 2/10 of I % lead.
5. Commercial building, industrial building, multiple residences and similar buildings and installations, a certificate
of Code Compliance from architect or engineer responsible for the building.
6. Submit Planning Board Approval of completed site plan requirements.
B. For existing buildings (prior to April 9, 1957) non-conforming uses, or buildings and "pre-existing" land uses:
I. Accurate survey of property showing all property lines, streets, building and unusual natural or topographic
features.

At your written request for a Certificate of Occupancy final site inspection, Planning Department staff
performed a site visit on January 5, 2007.
In reference to the above, the Planning Board held a work session on January 8, 2007 to discuss the
approved site plan dated April 13, 2004, Planning Staff site inspection comments and request for
satisfaction. This is to inform you that the site plan requirements have been satisfied conditionally and
include the following items:
· Th" Planning Board acknowledges the changes as noted on the as-built site plan dated August 7,
2003 and last revised site plan December 16, 2006 and approves the site plan as submitted.
· The owner agrees to complete the wall and remove the chain link fence on the northwest side of
the property within one year of the date of this letter.
This letter does not condone any changes from the site plan and approvals from other agencies if
required.

FINDINGS, DELIBERATIONS AND DETERMINATION
MEETING OF SEPTEMBER 11, 2003

Property Location:-7 0 Hummel Avenue, Southold; CTM #1000-63-2-30.1.
SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type II
category of the State's List of Actions, without an adverse effect on the environment if the
project is implemented as planned.
PROPERTY FACTS/DESCRIPTION: The applicant's 74,052 sq. ft. parcel has frontage along
two streets: Hummel Avenue to the north and Boisseau Avenue to the east, in Southold.
The widest frontage of the property along Boisseau Avenue is 156.10 feet, and 639.17 feet
along Hummel Avenue. The westerly lot line runs 105.05 feet deep to the Long Island
Railroad right-of-way. The property and existing buildings are used for warehousing and
storage. The property is zoned Light-Industrial (L1).
BASIS OF APPLICATION: Building Department's February 19, 2002 Notice of Disapproval,
amended March 10,2003, April 10, 2003, June 18, 2003, and June 19, 2003, citing Sections
100-142, 100-143A and 100-143C, in its denial of a building permit to construct new
buildings with interconnected hallways/additions.
FINDINGS OF FACT
The Zoning Board of Appeals held public hearings on this application on June 19, 2003
and August 7, 2003, at which time written and oral evidence were presented. Based upon
all testimony, documentation, personal inspection of the property, and other evidence, the
Zoning Board finds the following facts to be true and relevant:
AREA VARIANCE RELIEF/ORIGINAL REQUEST: The applicant's original application
requested relief to construct new buildings in this L1lndustrial Zone District requesting the
following area variance relief: (a) building area (ref. #3) with rear setbacks between five
feet and eight feet, maximum, from the southerly property line and at least 94'9" from the
front northerly lot line along Hummel Avenue; (b) building area (ref. #1) with a +-60 feet
setback from the front lot line along Hummel Avenue, and 220 fl. of linear frontage on
Youngs Avenue, and (c) building area (ref. #1 and #3) with side yard setback at 5 feel.
AMENDED ADDITIONAL RELIEF: During the June 19, 2003 public hearing, it was'
determined that the applicant had not filed an amended Appeal, based upon the June 19,
2003 amended Notice of Disapproval issued by the Building Department relative to the
Building Department's review of construction diagrams. On June 23, 2003, the appeal
application was amended to reflect the additional reason for disapproval by the Builc;ling
Department, for additional relief with regard to the third floor level with a proposed 2,000
sq. fl. of floor area for storage of files and certain office-related material, accessible by
elevator. The third-floor attic storage plan was prepared by East End Drafting & Design

and is dated 5-12-2003. Also, please refer to details shown on the 8-6-2003 site and
drainage plan prepared by East End Drafting & Design regarding proposed additions and
removal of existing buildings.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials
submitted and personal inspections, the Board makes the following findings:
1. Grant of the relief requested will not produce an undesirable change in the character of
the neighborhood or a detriment to nearby properties.
A. Setbacks for Buildina (Ref. #1. #2. and #3 and proposed additions to interconnect
buildinas #1 and #3 in the future: The existing setbacks facing Hummel Avenue are
substantially nonconforming: (1) the existing warehouse building "E" is +-32 feet to
the northerly front property line and +.17 feet to the existing fence, and (2) the existing
building, proposed to be removed, is closest to Hummel Avenue at +-20 feet. New
building #1 is proposed at 60'3" from the northerly property line and at least 5' from
the southerly property line. Building Ref. #2 is a new 2,546 sq. ft. building, to replace
the existing 70' x 24' wide warehouse building. The existing building is shown with
variable setbacks from the southerly property line between 12'3" and 9'10"; the new
building will maintain or exceed the setbacks of the existing building from the
southerly property line. Building #3 is proposed at a minimum of 94'9" from the
northerly property line, and with variable rear setbacks between 5' and 8', at its closest
points. The existing foundations are not salvageable. Only a small change of footprint
of the existing southerly building would occur.
B. Buildina Frontaaes: Building (Ref. #1) is proposed with 80 linear feet of building
width/frontage facing Boisseau Avenue. Presently, the entire easterly section of the
property facing Boisseau Avenue is used for outside storage of landscape materials.
The applicant is proposing to eliminate outside storage, and the closest new building
to Boisseau Avenue will be at least 89 feet from the easterly front property line. The
additional building frontages proposed in the future, by small additions,
interconnecting Buildings #1 and #3 are also included in this variance, as shown on the
site and drainage plan prepared by East End Drafting & Design dated 8-6-2003.
C. . Third Floor of BuildinQ #1' The third floor is proposed as an attic with elevator, for
storage of necessary files and related items.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for
the applicant to pursue, other than an area variance. The property is improved with
existing buildings in nonconforming locations. At least one of the buildings, which is
100% in a nonconforming location, will be removed and not be rebuilt. Outside yard areas
will not be used for open storage, and open parking and landscaped buffer areas will be
added to meet the requirements of the Planning Board under the site plan regulations.
3. The relief granted herein is substantial in relation to the code requirements for building
frontage, and front, rear and/or side yard setbacks. Where the rear yard setback Is

reduced, a front setback increased. Where the building frontage is greater than 60 feet,
existing nonconformities are either removed or reduced. The sizes of the storage
buildings are largely necessary to accommodate their boats indoors, where they can also
be properly outfitted and supplied for their purposes of rescue and salvage operations.
These responses require immediate and easy access despite the time of day or night or
weather conditions.
4. The difficulty was self-created when the new building construction was planned with a
design that will not conform to the current Town Code requirements.
5. There is no evidence that the grant of the relief will have an adverse effect or impact on
physical or environmental conditions in the neighborhood or district, after weighing the
factors which benefit to the applicant as compared to a detriment to the community. The
property is improved with buildings in poor condition, and foundations of which are not
salvageable. There is outside storage of landscape material in several piles on the
southeast section of the property. There are storage of trailers and vehicles, registered
and unregistered, which give an unsightly appearance. The applicant has assured that the
new office building will be state of the art with architectural marvel, even though it is three
stories with occupancy of the first two stories. Buildings #2 and #3 are to be
interconnected as one building for easy inside access from Building #1. These buildings
are to be located contiguous to the L1RR, on the south side of the property. A new office
complex with attached storage buildings and large parking lot to accommodate staff and
customers will be a better utilization of this Light Industrial zoned parcel.
6. Grant of the relief requested is the minimum action necessary and adequate to enable
the applicant to enjoy the benefit of new building areas, while preserving and protecting
the character of the neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the
balancing test under New York Town Law 267-B, motion was offered by Member
Goehringer, seconded by Member Orlando, and duly carried, to
GRANT the variances as requested, shown on the plans prepared by East End
Drafting & Design dated 5-12-2003, site plan dated 6-12-2003 prepared by Warren
A. Sambach, Jr., and site-drainage map prepared by East End Drafting & Design
dated 8-6-2003, SUBJECT TO THE FOLLOWING CONDITIONS:
1. Major retrofitting and overhauling of boats shall be done inside a building.
2. All communication systems used by staff shall be done within the buildings,
without an outside loud speaker system.
3. Consent be obtained from the owner or authorized authority with regard to
emergency fire access on the south side of the property within or along the
L1RR right-of-way as needed.
4. That designated parking within the site be used for vehicle purposes and not
for any type of storage.

5. The three buildings may be connected in the future as shown on the 6-12-2003
site plan prepared by Warren A. Sam bach, Sr., P.E., without a supplemental
application to the Board of Appeals.
This action does not authorize or condone any current or future use, setback or other
feature of the subject property that may violate the Zoning Code, other than such uses,
setbacks and other features as are expressly addressed in this action.

FINDINGS OF FACT
The ZonIng Board of Appeals held public hearings on this application on February 26,
2004, at which time written and oral evidence were presented. Based upon all testimony,
documentation, personal Inspection of the property, and other evidence, the Zoning Board
finds the following facts to be true and relevant:
RELIEF REQUESTED: The applicant maintains that the building Inspector erred In citing
Article VIII, Section 100-82A to deny them a building permit. Section 100-82 A states:
"Except as otherwise provided hereon. no bulldina or premises shall be used and no
bulldina or part thereof shall be erected or altered In the LB Districts unless the same
conforms to the Bulk Schedule and Parklna and loadina Schedules incorporated Into this
chapter bv reference. with the same force and effect as if such reaulations were set forth
herein full."
The Building Inspector further states that the proposed (multiple light industrial) use
would constitute a second use.
The applicant maintains that this property has had multiple uses continuously since
before the inception of zoning In Southold town and therefore qualifies as a pre existing
multiple light Industrial use.

REASONS FOR BOARD ACTION: On the basis of testimony presented, materials
submitted and personal inspections, the Board makes the following findings:
1. Anundesirable change will not be produced in the CHARACTER of the neighborhood
or a detriment to nearby properties, because this property has had multiple light industrial
uses since prior to the enactment of the zoning ordinance. According to an affidavit
submitted by James H. Rich Jr., the subject property has had In excess of 20 different
combinations of uses at varying times since 1920. These uses include a plumbing
contractor, masonry contractor, lumberyard, and landscaping contractor to name just a
few.
2. The benefit sought by the applicant (multiple light industrial use) has existed
historically on this property since before zoning.
3. The amount of relief requested Is not substantial. The property has a previous ZBA
approval to upgrade the buildings to allow for uses that are quieter, more attractive, self
contained, and conducted inside the buildings.
4. This request will not have an adverse effect or Impact on the physical or,environmental
conditions in the neighborhood or district because. the property. h.as, been used for
multiple light industrial uses for many years and the applicant only seeks to continue what
has historically existed.
BOARD RESOLUTION: Based on the above reasons the Board finds that the basis for the
Building Inspector's Notice of Disapproval was Incorrect.
NOW, therefore, on motion by Member Dlnizio, seconded by Chairwoman Oliva, it
was
RESOLVED, to REVERSE the January 26, 2004 determination of the Building
Inspector, finding that the applicant is not requesting an additional use on this
property but merely seeking to continue the multiple light industrial uses that have
existed for years.
Vote of the Board: Ayes: Members Oliva (Chairwoman), Goehringer, Tortora, Orlando,

r
a. This application MUST be completely f1lled in by typewriter or in ink and submitted to the Building Inspector with 4
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location oflot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approv~ of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zouing amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.
APPLICATION IS HEREBY MADE to the Building Department for the issuance of a Building Permit pursuant to the
Building Zone Ordinance of the Town of South old, Suffolk County, New York, and other applicable Laws, Ordinances or
Regulations, for the construction of buildings, additions, or alterations or for removal or demolition as herein described. The

AUTHORlZm ACTIVITY: A discharge to groundwater of 1000 to 10,000 gallons per day of sanitary waste, without the
admixture of industrial wastes, from on-site treatment works serving private, commefCial, and institutional facilities, in
accordance with tha requirements and conditions of this permit. Modifications for discharge volume and treatment works
may be undertaken that are within tha limits of tha authorized activity. Existing permitted discharges meeting thesa criteria
may be authorized with this general permit. EXCLUSIONS: Activitias excluded from this general permit are facilities in
special (100-vaar) flood hazard areas; freshwater and tidal wetlands and their adjacent araas as dafined in ECL Articlas 24
and 25; coastal erosion hazard areas as defined in ECL Articla 34; and wild, scenic, and recreational river corridors as
defined in ECl Title 27, Article 15. Also excluded is any facility that incorporates treatment units or processes not
referenced in Degon Standards for Wastewater Treatment Works - Intermediate Size Seweraae Facilities (1988 - published
by NYSDEC).

The attached plan, when duly signed by a representative of the department, in conjunction with these
conditions, constitutes a permit to construct a water supply and/or a sewage disposal or collection
system for the property as depicted. The applicant should take note of any conditions of approval, which
may be indicated on the plan or enclosed herein. Construction must conform with applicable standards
including "Standards for Approval of Plans and Construction for Sewage Disposal Systems for
Other than Single Family Residences." Omissions, inconsistencies or lack of detail on the plan do not
release the applicant from the responsibility of having the construction done in conformance with
applicable standards. Issuance of this permit shall in no way relieve the design professional of
responsibility for the adequacy of the complete design.
The permit (plan) expires three (3) years after the approval date. Any modification which may affect the
proposed sewage disposal or water supply systems requires submission of a revised plan and additional
fees (if applicable) for reapproval prior to construction. No inspections will be performed by the
department on expired permits.
Permits may be renewed, extended, transferred, or revised in accordance with the procedures described
in Instructions to Renew, Extend, or Transfer an Existing Permit for Other than Single Family
Residences (Form WWM-018).
It is the applicant's responsibility to call the department in advance to arrange inspections of the sewage
disposal and/or water supply facilities prior to backfilling. These include inspections of the sewage
collection and disposal systems, water supply system components and piping, and final grading as
shown on the approved plans. In certain cases, inspections of the soil excavation may be required to
determine the acceptability of the soils for sewage disposal systems. The department must be notified at
least 48 hours in advance to schedule an inspection by calling 852-2097; and excavation inspections
must also be confirmed by calling 852-2100 prior to 9:30am, the morning of the inspection.
Final approval issued by the Department is necessary prior to the occupancy of new buildings,
additions to existing buildings, or for the use of sewage disposal or water supply systems.

Dear Sir,
This letter is to inform you that I had inspected the reinforcing steel prior to the
placement of concrete in the recently completed metal building and found them to be in
accordance with the designs complete this structure. If you have any questions regarding
this matter please call.

BUILDING SPECIFICATIONS
The manufacturer is not responsible for the concrete foundotion design.
The structure under this contract has been designed and detailed for
the loads and conditions stipulated in the contract and shown on these
drawings. Any alterations to the structural system or removal of any
component ports, or the addition of other construction materials or loads
must be done under the advice and direction of 0 registered architect, civil
or structural engineer. The manufacturer will assume no responsibility for
any loads not indicated.
This manufactured building is designed with the manufacturer's standard design
practices which ore based on pertinent procedures and recommendations
of the following organizations and codes :
-American Institute of Steel Construction "Specification for the design
fabrication and erection of structural steel for buildings" 9th edition.
-American Iron and Steel Institute "Specification for the design of cold
formed steel structural members" 1996 edition.
-American Welding Society "Structural Welding Code" AWS Dl.1-98 Chapter
2 relating to prequa!ified complete joint penetration groove welds and chapter
8 port B relation to allowable stresses.
-Metal Building Manufacturers Association "Specification for the design
fabrication and erection of the structural system" most current edition.
Mate6al properties of steel plate and sheet used in fabrication of
primary rigid frames and 011 primary structural framing members (other than
cold-formed sections) conform to ASTM A-529 or A-570 or A-572 all with 0
minimum yield point of 60 KSI.
Material properties of cold formed light gage steel members conform to the
requirements of ASTM A-570, with 0 minimum yield point of 60 KSI.
High strength bolts and their installation sholl conform to ASTM specification
A-325 and are designed os bearing type connections with threads included in
the shear plane. Tightening of these bolts is recommended by the
Turn-of-the-nut method, per "AISC Specification for Structural Joints."
All primary structural members except bolts and fasteners shall receive one
coat of Iron Oxide inhibitive primer.
Shop and field inspections and associated fees ore the responsibility of the
contractor, unless stipulated otherwise.
CONTRACTOR RESPONSIBILITIES
The controctor must secure 011 required approvals and permits from the
appropriate agency os required.
Approval of the manufacturer's drawings and calculations indicate that
the manufacturer has correctly interpreted and applied the requirements
of the contract drawings and specifications. (Sec. 4.2.1 AISC Code of
Standard Practice, 9th edition.)
Where discrepancies exist between the manufacturer's structural steel plans
and the plans for other trades, the structural steel plans sholl govern.
(Sec. 3.3 AISC Code of Standard Practice, 9th edition.)
Design considerations of any materials in the structure which ore not
furnished by the manufacturer, ore the responsibility of the contractor and
engineers other than the manufacturer's engineering, unless specifically indicated.
The contractor is responsible for 011 erection of steel and associated work
in compliance with the manufacturer's "For Construction" drawings.
Temporary supports, such as guys, braces, flashwork or other elements
required for the erection will be determined and furnished and installed by
the erector. (Sec. 7.9.1 AISC Code of Standard Practice, 9th edition.)
It is the contractors responsibility to apply or observe 011 pertinent safety
rules and regulations, as per OSHA standards os applicable.
The Contractor is responsible for the verification of 011 shipments received.
Any "external" damage or shortages must be noted on 011 copies of the bill
of lading and one copy is to be retained for your records. Failure to do so
will make it impossible for the factory to honor any claim. NO EXCEPTIONS!!!

Be advised that all shipments are via outside trucking companies and are
signed for in good condition and completeness at the pick-up location by the
driver.

At the delivery point the driver is required to provide you
with a bill of lading which lists and illustrates all bulk

SPECIAL NOTE:
Overhead doors and service doors are shipped in
cardboard boxes. It is required that they be opened to
insure that the trucker's chains have not damaged the
edges. If so, it must be noted on the bill of lading.
INTERNAL:
Before the driver leaves, it is also required that you receive a
Shipper Report (packing list) that specifies all internal
quantities of individual parts. However, the Roof and Wall
Sheeting must be counted prior to releasing the driver. Valid
concealed shortages must be reported to the factory within 30
calendar days No exceptions!!! The driver does not have
to be present for the internal inventory.
