This application milst be filled in by typewriter or ink and submitted to the Building Department with the following:
A. For new building or new use:
1. Final survey of property with accurate location of all buildings, property lines, streets, and unusual natural or
topographic features.
2. Final Approval from Health Dept. of water supply and sewerage-disposal (S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contains less than 2/10 of 1 % lead.
5. Commercial building, industrial building, multiple residences and similar buildings and installations, a certificate
of Code Compliance from architect or engineer responsible for the building.
6. Submit Planning Board Approval of completed site plan requirements.
B. For existing buildings (prior to April 9, 1957) non-conforming uses, or buildings and "pre-existing" land uses:
1. Accurate survey of property showing all property lines, streets, building and unusual natural or topographic
features.
2. A properly completed application and a consent to inspect signed by the applicant. If a Certificate of Occupancy
is denied, the Building Inspector shall state the reasons therefor in writing to the applicant.

At your written request for a Certificate of Occupancy final site inspection, Planning Department staff
performed a site visit on January 5, 2007.
In reference to the above, the Planning Board held a work session on January 8, 2007 to discuss the
approved site plan dated April 13, 2004, Planning Staff site inspection comments and request for
satisfaction. This is to inform you that the site plan requirements have been satisfied conditionally and
include the following items:
· Tht: Planning Board acknowledges the changes as noted on the as-built site plan dated August 7,
2003 and last revised site plan December 16, 2006 and approves the site plan as submitted.
· The owner agrees to complete the wall and remove the chain link fence on the northwest side of
the property within one year of the date of this letter.
This letter does not condone any changes from the site plan and approvals from other agencies if
required.

consideration in this application and determines that this review falls under the Type II
category of the State's List of Actions, without an adverse effect on the environment If the
project Is Implemented as planned.

PROPERTY FACTS/DESCRIPTION: The applicant's 74,052 sq. ft. parcel has frontage along
two streets: Hummel Avenue to the north and Boisseau Avenue to the east, in Southold.
The widest frontage of the property along Boisseau Avenue is 156.10 feet, and 639.17 feet
along Hummel Avenue. The westerly lot line runs 105.05 feet deep to the Long Island
Railroad right-of-way. The property and existing buildings are used for warehousing and
storage. The property is zoned Light-Industrial (L1).
BASIS OF APPLICATION: Building Department's January 26, 2004 Notice of Disapproval,
under Section 100-82A, stating that the bulk schedule allows one use per 40,000 sq. ft.,
and the use, as proposed, would constitute a second use.
FINDINGS OF FACT
The Zoning Board of Appeals held public hearings on this application on February 26,
2004, at which time written and oral evidence were presented. Based upon all testimony,
documentation, personal inspection of the property, and other evidence, the Zoning Board
finds the following facts to be true and relevant:
RELIEF REQUESTED: The appliCant maintains that the building inspector erred In citing
Article VIII, Section 100-82A to deny them a building permit. Section 100-82 A states:
"Except as otherwise provided hereon. no buildlna or premises 'shall be used and no
buildina or Dart thereof shall be erected or altered In the LB Districts unless the same
conforms to the Bulk Schedule and Parklno and (oadlno Schedules Incorporated Into this
chapter bv reference. with the same force and effect as If such reaulations were set forth
herein full."
The Building Inspector further states that the proposed (multiple light Industrial) use
would constitute a second use.
The applicant maintains that this property has had multiple uses continuously since
before the Inception of zoning in Southold town and therefore qualifies as a pre existing
multiple light industrial use.

REASONS FOR BOARD ACTION: On the basis of testimony presented, materials
submitted and personal inspections, the Board makes the following findings:
1. An undesirable change will not be produced in the CHARACTER of the neighborhood
or a detriment to nearby properties, because this property has had multiple light Industrial
uses since prior to the enactment of the zoning ordinance. According to an affidavit
submitted by James H. Rich Jr., the subject property has had in excess of 20 different
combinations of uses at varying times since 1920. These uses include a plumbing
contractor, masonry contractor, lumberyard, and landscaping contractor to name just a
few.
2. The benefit sought by the applicant (multipie light industrial use) has existed
historically on this property since before zoning.
3. The amount of relief requested is not substantial. The properly has a previous ZBA
approval to upgrade the buildings to allow for uses that are quieter, more attractive, self
contained, and conducted inside the buildings.
4. This request will not have an adverse effect or impact on the physical Qr, environmental
conditions In the neighborhood or district because, the prQpertyh.as, been used for
multiple light industrial uses for many years and the applicant only seeks to continue what
has historically existed.
BOARD RESOLUTION: Based on the above reasons the Board finds that the basis for the
Building Inspector's Notice of Disapproval was incorrect.
NOW, therefore, on motion by Member Dinizio, seconded by Chairwoman Oliva, it
was
RESOLVED, to REVERSE the January 26, 2004 determination of the Building
inspector, finding that the applicant is not requesting an additional use on this
properly but merely seeking to continue the multiple light Industrial uses that have
existed for years.
Vote of the Board: Ayes: Members Oliva (Chairwoman), Goehringer, Tortora, Orlando,

f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.

The following resolution was adopted at a meeting of the Southold Town Planning
Board on Monday, April 12, 2004:
The final public hearing was closed.
WHEREAS, the proposed site plan, to be known as Sea Tow Corporate Headquarters,
is for a new 19,540 sq. ft. three-story office building (Building #1), renovation of an
existing 3,519 sq. ft. warehouse (Building #2), a new 2,800 sq. ft. warehouse (Building
#3), a new loading dock of 696 sq. ft. and an existing building with 9,105 sq. ft. of
warehouse (Building E) on a 1.7693 acre parcel in the LI Zoning District located in
Southold; and
WHEREAS, Towbee, LLC is the owner of the property known and designated as 700
Hummel Avenue, located at the intersection of Hummel Avenue and Boisseau Avenue,
on the southeast corner, in Southold, SCTM#1 000-63-2-30.1; and
WHEREAS, on July 24, 2003, a formal application for approval of this site plan was
submitted; and
WHEREAS, on September 11,2003 the Southold Town Zoning Board of Appeals
granted a variance with conditions as described under Appeal Number 5355; and
WHEREAS, on October 9, 2003, the Southold Town Planning Board, acting under the
State Environmental Quality Review Act (6 NYCRR), Part 617.6, performed a review

of this unlisted action, and as lead agency, made a determination of non-significance
and granted a Negative Declaration on December 9, 2003; and
WHEREAS, on November 13, 2003, the Southold Town Fire District found adequate fire
protection for this site plan and provided a letter indicating validity for one year and the
Planning Board has accepted this recommendation; and
WHEREAS, on January 20, 2004, the Suffolk County Department of Health Services
approved a Permit Number C10-03-0013; and
WHEREAS, on January 29, 2004, the Architectural Review Committee reviewed the
architectural drawings, in accordance with its recommendations of November 6, 2003,
and determined they were satisfactory; and
WHEREAS, on March 4, 2004 the Southold Town Zoning Board of Appeals reversed
the January 26, 2004 determination of the Building Inspector as described under Appeal
Number 5492; and

WHEREAS, on March 9, 2004, the Town Board voted on Resolution Number 220/
known as Local Law Number 7 of 2004, a Local Law in relation to No Parking on/,
Hummel Avenue, Southold, New York and said law will prohibit parking on the south
side of Hummel Avenue, thereby eliminating the need for curbing to be installed along
the north property line of this site; and
/
WHEREAS, on April 2, 2004, the South old Town Building Inspector reviewed and
certified the site plan; and
WHEREAS, on April 8, 2004, the South old Town Engineer reviewed anJ approved the
proposed drainage and the Planning Board has accepted his recommendation for
approval; and
WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice of
Public Hearing, has received affidavits that the applicant has complied with the
notification provisions; and
WHEREAS, all the requirements of the Site Plan Regulations of the Town of South old
have been met; be it therefore
RESOLVED that the Southold Town Planning Board grant final approval on the site plan
prepared by East End Design Association and certified by Joseph Fischetti,
Professional Engineer, dated August 7,2003 and last revised March 6, 2004, and
authorize the Chairperson to endorse the final site plans with the following condition and
subject to a one year review from the date of issuance of the building permit:

1 ) All outdoor lighting shall be shielded so that the light source is not visible from
adjacent properties and roadways, Lighting fixtures shall focus and direct the
light in such a manner as to contain the light and glare within property

2) All signs shall meet Southold Town Zoning Codes and be subject to approval
from the Southold Town Building Inspection.
3) Under Southold Town Code Section 100-254 Part 4 b, the Planning Board
grants final approval for less than the required number of spaces for that use; the
Planning Board shall have the right to review the parking requirements again if a
change in use is proposed.

one to be submitted to the Building Department when you apply for your Building
Permit.

This letter is to request continuation my interpretation of this section of the code (1005.2.1)
indicating that the minimmn number of exits required for every floor as per table 1005.2.1 may be
reduced based on the occupant load ," modified in section 1 004.2.1 or section 1005.2.2. The second
floor of the SeaTo,," building ,\-il! require one exit as long as Section 1004.2.1 or section 105,5.2 is met.

The attached plan, when duly signed by a representative of the department, in conjunction with these
conditions, constitutes a permit to construct a water supply and/or a sewage disposal or collection
system for the property as depicted. The applicant should take note of any conditions of approval, which
may be indicated on the plan or enclosed herein. Construction must conform with applicable standards
including "Standards for Approval of Plans and Construction for Sewage Disposal Systems for
Other than Single Family Residences." Omissions, inconsistencies or lack of detail on the plan do not
release the applicant from the responsibility of having the construction done in conformance with
applicable standards. Issuance of this permit shall in no way relieve the design professional of
responsibility for the adequacy of the complete design.
The permit (plan) expires three (3) years after the approval date. Any modification which may affect the
proposed sewage disposal or water supply systems requires submission of a revised plan and additional
fees (if applicable) for reapproval prior to construction. No inspections will be performed by the
department on expired permits.
Permits may be renewed, extended, transferred, or revised in accordance with the procedures described
in Instructions to Renew, Extend, or Transfer an Existing Permit for Other than Single Family
Residences (Form WWM-018).
It is the applicant's responsibility to call the department in advance to arrange inspections of the sewage
disposal and/or water supply facilities prior to backfilling. These include inspections of the sewage
collection and disposal systems, water supply system components and piping, and final grading as
shoWIl on the approved plans. In certain cases, inspections of the soil excavation may be required to
determine the acceptability of the soils for sewage disposal systems. The department must be notified at
least 48 hours in advance to schedule an inspection by calling 852-2097; and excavation inspections
must also be confirmed by calling 852-2100 prior to 9:30am, the morning of the inspection.
Final approval issued by the Department is necessary prior to the occupancy of new buildings,
additions to existing buildings, or for the use of sewage disposal or water supply systems.

Inspected placement pf concrete in foundation walls - All steel in accordance with plans
_ concrete placed in 3 foot layers - I notified contractor that the vibration of the walls was
critical and to use his best men not the laborers.
Inspected I st floor reinforcement prior to placement of concrete - all steel in
accordance with plans. The builder did not know where to make cold joints during
placement. I suggested that he call engineer in Florida prior to the placement of next floor
for direction. He kept cold joints away from middle of any beams. Some of the re-bar
chairs were being pushed into the insulation - Contractor was notified.
Inspected I st floor wall reinforcing prior to placement of concrete. All steel installed in
accordance with plans -
Inspected steel in 2nd floor - All steel OK. Chairs were better this time - the contractor
had spoken to the FL engineer for cold joints.
Not notified when the 2nd floor walls were placed - No inspection was made
3'd floor concrete was placed without notification - The floor was placed when the outside temperature
was below freezing and stayed that way for a number of days. I spoke to Capt. Joe to notify the FL
engineer that this has occurred and that cores of the slab may be required to assure the proper strength of
the floor.
