part in and to the premises conveyed to party of the first part by John S.
Lockman and Virginia K. Lockman by deed dated June 26, 1980, recorded in Liber
8848, page 89 in the Office of the Clerk of Suffolk County, New *York on July 8,
1980, subject to" (i) any state of facts which an accurate survey may show, (ii)
rights of the People of the State of New York in those portions of the above
described premises now or formerly under the waters of Long Island Sound, (iii)
1/ rights of the Federal Government to enter upon and take possession without com-
pensation of lands now or formerly lying below the high water mark of Long Island I
sound and (iv) riparian rights of others in and to the wateirs of Long Island
SIS Sound as the same adjoins the said premises.

New York affecting the said premises, including but not limited to the
Mortgage made by John S. Lockman and Virginia K. Lockman in favor of Irene R.

in the Suffolk County Clerk's Office in Liber 6250 of Mortgages, page 249,
and the Mortgage made by party of the first part herein in favor of John S.
A,0 TI Lockman and Virginia K. Lockman dated June 26, 1980 and recorded in the Suffolk .
County Clerk's Office in Liber 8776 of Mortgages, page 460, which last said
306001D Mortgage dated June 26, 1980 and the Note secured thereby were assigned by
John S. Lockman and Virginia K. Lockman-to party of the first part herein
simultaneously herewith and immediately prior hereto, it being intended by
said party of the first part that gaid assigned Mortgage and the fee title
to the above described premises shall not have merged when said Mortgage
was held and said premises were owned by party of the first part.

AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will appy
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.

ALL that certain plot, piece •or parcel of land, with the
buildings thereon erected, situate, lying and being in the
Town of Southold, County of Suffolk and State of New York,
known and bounded and described as follows:
BEGINNING at a point on the northerly side of Leeton Drive
a distance of 650 feet measured along the northerly side
of Leeton Drive from the intersection formed by the northerly
side of Leeton Drive with the westerly side of Kenney' s Road;
RUNNING THENCE North 44 degrees 24 minutes 30 seconds West,
210 feet, more or less, to the mean highwater mark of Long
Island Sound;
RUNNING THENCE westerly along the mean highwater mark of
Long Island Sound 175 feet more or less to the easterly
side of property formerly of James W. Hertsch;
RUNNING THENCE along the easterly side of property formerly
of James W. Hertsch, South 44 degrees 24 minutes 30 seconds
East, 184 feet, more or less, to the northerly side of Leeton
Drive;
THENCE RUNNING North 45 degrees 35 minutes 30 seconds East
along said northerly side of Leeton Drive, 175 feet to the
point or place of BEGINNING.

Street, New York, N. Y. , as grantor-mortgagee, and ZAFAR U. H. FATIMI and
KHEM P. FATIMI, his wife, residing at 53 Howells Point Road, Bellport,
New York, as grantee-mortgagors of the following described premises :
ALL that certain plot, piece or parcel of land, with the buildings and
improvements thereon erected, situate lying and being in the Town of
Southold, County of Suffolk, and State of New York, known and bounded
and described as follows: BEGINNING at a point on the westerly side of
Kenney' s Road where the northerly side of Leeton Drive intersects the
same; THENCE RUNNING south 45° 35 minutes 30 seconds best along said
northerly side of Leeton Drive 650 feet to the point or place of beginning
of the premises hereby described: BEGINNING at said last mentioned point
of beginning, RUNNING THENCE north 44° 24 minutes 30 seconds west 262 feet,
more or less, to the mean high water line of Long Island Sound; RUNNING
THENCE westerly along the mean high water mark of Long Island Sound 175
feet, more or less, to the easterly side of property of James W. Hertsch;
RUNNING THENCE along the easterly side of property of James W. Hertsch,
south 44° 24 minutes 30 seconds east 249 feet, more or less, to the
northerly side of Leeton Drive and THENCE RUNNING easterly along said
northerly side of Leeton Drive 175 feet to the point or place of BEGINNING.

as evidenced by a bond and mortgage made by JOHN S . LOCKMAN and VIRGINIA
K. LOCKMAN, his wife, to IRENE R. MEISSNEST, dated December 27 , 1971 and
recorded in the Office of the Clerk of Suffolk County in Liber 6250 of
Mortgages at page 249 on January 7, 1972, now a lien on the property in
the sum of $18 ,164 . 59 with interest at the rate of six and one-half
percent (6 1/2%) per annum from February 27 ,7E
