ALL that certain plot, piece or parcel of land, situate, lying
and being at Southold, in the Town of Southold, County of Suffolk
and State of New York, bounded and described as follows:
BEGINNING at a point on the westerly side of Gagens Landing.
Road, said point being distant 120.59 feet northerly as measured
along the westerly side of Gagens Landing Road from the corner formed
by the intersection of the northerly side of Clearview Avenue with
+the westerly side of Gagens Landing Road and from said point of
beginning; running thence north 85 degrees 15 minutes 00 seconds
west 156.01 feet to lands nolo or formerly of Terp; ence along said
lands north 01 degrees 28 minutes 10 seconds east _1.73 'eet to
lands now or formerly of Butkovich; thence along saiff-1ands south
87 degrees 58 minutes 10 seconds .gest 149.93 feet to.the westerly
side of Gagens Landing Road; thence along the westerly side of
Gagens Landing Road south 02 degrees 01 minutes 50 seconds east 100.00
feet to the point or place of beginning.
Together with the right to the use of a right of way in common
with others over said proposed highway from the northeasterly
corner of the premises Southerly about 220 feet to Clearview Avenue.
SUBJECT, however, to the following covenants and restrictions:
1. That every dwelling house erected on said premises shall
cost not less than Eight Thousand ($8,000.00) Dollars;
2. No fowl and/or animals other. than the usual type of house-
hold pets are to be kept on said premises.
RESERVING to the party of the first part, her heirs and assigns,
the right to dedicate said private road to the Town of Southold as a
public highway, and the party of the second part, by the acceptance
of this deed, does hereby consent to such dedication,and does hereby
release the said Town of Southold from any liability for damages by
reason of said dedication of said private road as a public highway.
Being the same premises conveyed by Sarah E. Gagen to Bernard
G. Gagen by warranty deed dated April 55 1957 and recorded in the
Suffolk County Clerk's Office on the 25th day of April, 1957 in Liber
4292 of Deeds, at page 72, the description of r:hich deed was corrected
