TOGETHER with right of free access and approach to the Creek along extension of the Bayberry Road a width of fifteen (15) feet as laid out on said map. BEING AND INTENDED TO BE the same premises as conveyed to the party of the first part by deed dated June 1, 1940 and recorded in the Suffolk County Clerk's Office on August 2, 1940 in Liber 2113 Page 475; and by deed dated July 14, 1943 and recorded in the Suffolk County Clerk's office on November 12, 1943 in Liber 2322 Page 565. *Said lots when taken together are bounded and described as follows: BEGINNING at the corner formed by the intersection of the northeasterly side of Main Bayview Road with the southeasterly side of Bayberry Road; running thence North 41° 44' 10" East along said southeasterly side of Bayberry Road, 126.10 feet to a monument; thence South 480 15' 50" East along the southwesterly line of Lot No. 16, 125.81 feet to a monument; thence South 390 55' 00" West along lands of Zukas, 120.00 feet to a monument and the northeasterly side of Main Bayview Road; thence North 51° 00' West along the northeasterl- side of Main Bayview Road, 129.71 feet to a monument and the point or place of BEGINNING. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof ; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
