BROWN of 1351 Merrick Avenue, North Merrick, -NY 11566 age I cggo party of the second part, i� Vey WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and beingicibbsx at Bay View, near Southold, in the Town of Southold, County of Suffolk and State of New York, being known and designated as Lots Numbers 77 and 78 on a certain map entitled "Map of Goose Neck, situate at Bay View, Town of Southold, Suffolk County, N.Y., owned by G.W.Smith & Sons," spade by Otto W. Van Tuyl,'Licensed Surveyor,Greenport, N.Y., and filed in the Suffolk County Clerk's Office on November 22,1948, as and by File No. 1663., TOGETHER with all th`e sight, title and interest, if any of the party of first part, in and to the highway in front of and abutting said premises, to the center line thereof. BEING and intended to be-a=r_^=`_=== _` the premises heretofore conveyed to the party of the first part by ROSS J. SPARACIO and ANNE SPARACIO, his wife by deed dated October 18, 1974, and filed in the Office of the Regis- trar of Suffolk County pursuant to Article 12 of the Real Property Law (Land Title Registration) under Certificate of Title Number 96537 on October 18, 1974. SUBJECT to any state of facts an accurate survey may show, provided same does not render the title unmarketable. TOGETHER with the right to use, for all reasonable purposes, in common with others, subject to such reasonable rules and regulations with respect to the use thereof as George W. Smith & Sons, Inc. may from time to time put into effect, that portion of Lots No. 37 and 38 and part of Lot 39 on said map, known as the beach property, it being the intention of the said George W. Smith & Sons, Inc. to grant to the parties of the second part the same rights that it has heretofore granted to other grantees of lots on said map. TOGETIIER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
