The grantees herein, Clifford Githmark and Caroline D. Githmark, his wife, herebelow affix their signatures to this instrument evidencing their agreement to assume and pay the existing mortgage on the premises described herein which was made to the Southold Savings Bank by Gary T. Winters and Elaine M. Wintera, his wife, in the amount of $15,000.00, dated the 9th day of November,, 1965 and recorded in the office of the Clerk of the County of Suffolk on November 11, 1965 in Liber 4803 at page 45 and mortgage dated November 9, 1971, made by Gary T. Winters' and Elaine M. Winters, his wife, to Southold Savings Bank in the amount of $9,140.82, recorded in the office of the Clerk of the County of Suffolk on November 19, 1971 in Liber 6204 at page 83, which mortgage contained a statement consolidating it with the first mortgage set forth above to form a valid first lien on the premises in the amount of $21,500.00 and mortgage dated March 21 1973 made by'Gary T. Winters to the Southold Savings Bank in the amount of $14,847.94, recorded in the office of the Clerk of the County of Suffolk on March 6, 1973 in Liber 6657 at page469, which mortgage contained a statement consolidating it with the first two mortgages set forth above to form a valid first lien on the premises of $36,000.00. The present remaining principal balance on said mortgage on December 2, 1983 is $30,724.85, with interest paid to December 2, 1983. The grantors herein assumed the above mortgages on July l.. 1976 simultaneously with conveyance of the above described premises by Gary T. Winters to Edward L. Hoffman and Eva G. Hoffman, his wife, AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been incumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
