HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have Leen encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvcrnent and will apply
the same first to the Layment of the cost of the improvement ILefore using any part of the total of the same for
any other purl,ose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.

bounded and described as follows:
BEGINNING at a point in the northwesterly corner of the herein described premises,
said point being distant the following two courses and distancesfrom a point where
the southeasterly side of land now or formerly of William Zukas intersects the
southwesterly side of Main Bayview Road: (1) South 59 degrees O1' 00" East 63.68
feet; (2) South 25 degrees 16' 10" West 168.51 feet to the true point or place of
beginning; and running -
THENCE from said true point or place of beginning South 64 degrees 43' SO" East 165
feet to land now or formerly of W. Berg;Isaid point being distant South 25 degrees
