This application must be filled in by typewriter or ink and submitted to the Building Department with the following:
A. For new building or new use:
1. Final survey of property with accurate location of all buildings, property lines, streets, and unusual natural or
topographic features.
2. Final Approval from Health Dept, of water supply and sewerage -disposal (S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contains less than 2/10 of I% lead.
5. Commercial building, industrial building, multiple residences and similar buildings and installations, a certificate
of Code Compliance from architect or engineer responsible for the building.
6. Submit Planning Board Approval of completed site plan requirements.
B. For existing buildings (prior to April 9, 1957) non -conforming uses, or buildings and "pre-existing" land uses:
1. Accurate survey of property showing all property lines, streets, building and unusual natural or topographic
features.
2. A properly completed application and consent to inspect signed by the applicant. If a Certificate of Occupancy is
denied, the Building Inspector shall state the reasons therefor in writing to the applicant.

SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions,
without an adverse effect on the environment if the project is implemented as planned.
PROPERTY FACTS/DESCRIPTION: The applicant's 1.04 acre parcel has 219 feet along Smith Road in
Cutchogue, and a survey dated March 2, 2001, amended March 17, 2005 by Peconic Surveyors indicates a
dwelling and accessory building.
BASIS OF APPLICATION: Building Department's April 12, 2005 Notice of Disapproval, citing Sections 100-
33C and 100-244B, in its denial of an application for a building permit for additions and to create a workshop in
an existing accessory garage second -story for private use by the owners. The reasons stated by the Building
Inspector in the disapproval are that a workshop is not a permitted accessory use and that the principal
setback will be less than 50 feet from the front property line.
On October 24, 2005, the Building Inspector issued an amended Notice of Disapproval concerning recent
changes in the scope of work, for a permit to demolish the existing accessory garage and construct a new
accessory garage building to be used as a workshop. The same Sections of the Zoning Code were cited in
the amended Notice of Disapproval concerning the setback and workshop as a non -permitted use.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on November 17, 2005 at which time
written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of
the property, and other evidence, the Zoning Board finds the following facts to be true and relevant:
AREA VARIANCE RELIEF REQUESTED: The applicants wish to construct a 26' by 34' accessory garage
building with a setback measured at 23.3 feet from the front lot line along Smith Road shown on Site Sheet S-1
dated 4-26-05 prepared by Mark K. Schwartz, A.I.A. The new height of the accessory building is proposed to
conform to the code, with the revised plans showing a maximum height of 22 feet 9.25 inches to the top of the
ridge, and a required maximum mean height of 18 feet, measured from ground.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal
inspections, the Board makes the following findings:
1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a
detriment to nearby properties. Continued maintenance of the existing landscaping and screening ensures

that the character of the neighborhood will continue without an undesirable change as a result of the setback
location of the garage reconstruction. Any effect by this reduction of the front yard setback will be sufficiently
mitigated by two retaining walls between the garage and the property line.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to
pursue, other than an area variance. A private workshop for the owner's own use is not uncommon and has
been a permitted accessory use. The location is similar to the nonconforming location of the former accessory
garage.
3. No evidence has been submitted to suggest that a variance in this residential community will have an
adverse impact on the physical or environmental conditions in the neighborhood.
4. The relief requested is not substantial because a garage is permitted to be used as a private workshop by
the owner as an accessory use.
5. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to
enjoy the benefit of a private workshop area in a new garage, after removing the existing garage, while
preserving and protecting the character of the neighborhood and the health, safety and welfare of the
community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under
New York Town Law 267-B, motion was offered by Member Simon, seconded by Member Goehringer, and
duly carried, to
GRANT the variance as applied for, as shown on the first floor plan dated 4-26-05 and second -floor
plan with a ZBA date stamp of July 27, 2005, and as shown on Site Map S-1, prepared by Mark
Schwartz, A.I.A., SUBJECT TO THE FOLLOWING CONDITIONS:
1. That the workshop area over the first floor of this garage shall be non-commercial and non -
habitable.
2. That plumbing for heating and air-conditioning for a climate controlled area related to the owner's
private workshop use, and half bath (sink and toilet), shall be permitted.
This action does not authorize or condone any current or future use, setback or other feature of the subject
property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly
addressed in this action.
Vote of the Board: Ayes: Members Of (Chairwoman), Orlando, Goehringer, Dinizio, and Simon. This
Resolution was duly adopted (5-0).

f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18'mbnths fiom such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be. required.

Section R602.8 - FIREBLOCKING REQUI'.RED
Fireblocking shall be provided to cut ofall concealed draft openings (both vertical and horizontal)
and to form an effective fire barrier between stories, and between a top story and the roof space.
Fireblocking shall be provided In wood -frame construction in the following locations.
1). In concealed spaces of stud walls and partitions, Including furred spaces, at the ceiling and floor
levels. Concealed horizontal furred spaces shall also be fireblocked at intervals not exceeding 10
feet. Batts or blankets of mineral or glass fiber shall be allowed as Fireblocking in walls constructed
using parallel rows of studs or staggered studs.
2). At all interconnections between concealed vertical and horizontal spaces such as occur at soffits,
drop ceilings and cove ceilings.
3). In concealed spaces between stair stringers at the top and bottom of the run. Enclosed spaces
under stairs shall comply with Section R314.8, N.Y.S. Residential Code.
4). At openings around vents, pipes and ducts at ceiling and floor level, to resist the free passage of
flame and products of combustion.
5). For the fireblocking of chimneys and fireplaces, refer to Section R1001.16. N.Y.S. Residential Code.
