TOGETHER with an :aS2ifl2nt ~w8nty-~i~e ~cet in width as shewn on a
certain map made by Ro~erick Van Iuyl dated June 26. 1973 and last
.amended DeceInber 30,1980, which c,ap was filed by the Planning Board
of the Town of Southold uDder JaLed of April 7, 1981, wh'ch easement
extends across other land now of Gertrude Duchow and runs to the
northwesterly corner of other land of Gertrude Duchow as described
in Parcel A annexed hereto and further, together with an easement
fifteen feet in width from the northwest corner of premises owned by
Gertrude Duchow to Indian Neck Lane.
With regard to the filed subdivision map of the subject premises
(Parcel "B") as approved April 27, 1981 and specifically with
regard to lot #2 on said subdivision map, purchaser or purchaser's
representatives, assigns or successors in title shall not, for a
period of four (4) years from the date November 18, 1982 O~~h;~
CD~~~~~~, place erect or build any dwelling, building or other
'str'Gcture upon any portion of the premises described herein. The
same restriction shall apply to lots #3 and #4, however, the period
of time in which building shall not take place shall be three (3)
years. This restriction shall automatically cease four (4) years
from November 18, 198~pon the de~th of Gertrude Duchow, whichever
takes place first. hny deed or instrument conveying all or any
portion of the premises described herein shall include this covenant
and restriction and the same shall run with the land. Any breach
or failure to comply shall result in the reconveyance of said property
as described in Schedule "B" or the balance of said. property as then
owned by purchaser or purchaser'S assigns to seller.
It is understood and a reed that a life estate in t ' -~
cribed in Parcel A has been reserve 0 er rude Duchow and a~whic~
premises Gertrude Duchow is residing, and that said Gertrude Duchow(
is to have the use, occupation and profits of said premises a~ to
control it for and during her natural life. Gertrude Duchow's
obligations in connection with said premises shall be limited to
(1) payment of real estate taxes on Parcel "A" only, not to exceed
-One Thousand ($1,000.00) Dollars per year and (2) to maintain fire
and homeowner's insurance (both to the extent separately provided)
and (3) to maintain the grounds around the residence in a neat and
orderly manner and (4) to maintain the interior of the dwelling by
keeping the plumbing, heating and electrical systems in working
order and performing necessary cleaning an~ maintenance.
Being and intended to be the same premises as conveyed to the party
of the first part by deed dated November iI, 1982 and recorded on
November 24, 1982, in Liber.~275 page 137.
